To be quite honest... from what I have seen, this new drama with Brett all started with that video against TJ during HIS fortnight of shit against Coughlan. That video was a mistake and was taken down, TJ and Brett have settled their differences (albeit at a convenient time for TJ to use as a weapon against coughlan)... it should have all been dropped at that time, but people being human decided to look further into matters and dig up the past.

There are also those who just get their rocks off picking on anyone that they think they can get by with doing it to. They are taking his channel down now.

They are far worse than Brett ever was because they are stealing from others their right to choose whether they want to view Brett's videos or not. Brett never took their freedom of choice away from them.

erm... actually, there is a wall of evidence to say that yes, he did. As much as he wants to deny it, and as much as I don't want to believe it, he did falsely DMCA several of straightd0pe's videos to the point of suspension. There are plenty who would have liked to continue watching him.

Well, I don't know if he did or not. But, one thing that I am certain of is that the entire event never would have occurred if people had just left him alone to run his channel as he was doing. That includes straightd0pe.

One thing is for certain, he DID drops docs. I don't know if he's behind the straightd0pe false DMCAs or not, but for publishing a person's personal address info, email, etc. on YT, that's pretty deserving of the YT death penalty.

No the address was a public web hosting address and he did it in defense when people were posting his home address and phone numbers on various sites. Those users are still around. You think that is fair?

Yeah, it IS bullshit. I saw the video, and ONCE again, there's NO indication that the address was a commercial (compared to a personal) address. I was also around in Brett's early days and recall all his drama bullshit and saw the Judelicious vid exposing his plagarism, but that's not nearly as bad as dropping docs.

The DMCA is federal law. To falsify information on a legal document is perjury. Perjury is an obstruction of justice, and a crime.

First off, I though you were talking about dropping docs. Second, a judge has to rule on the legitimacy of the DMCA filed, before it could possibly be deemed a false filing. Third, case law has not been tested, to my knowledge, in filing DMCAs that counter harassment or defamation, which are crimes themselves. Fourth, any filing filed in good faith of a favorable ruling, is not considered a false filing. The only way your argument could stand, is if in the end, none of these criteria are met.

You appear to be confused in the difference between a civil and a legal case. DMCA is entirely and unequivocally about copyright. If a DMCA charge is filed against a work that contains no copyrightable material, or what copyrightable material therein falls under fair use, the charge is false, and the filer has perjured eirself.

Defamation and harassment are civil, not legal matters.

I'm not at all confused by the difference between a civil and a criminal case, perhaps you are. In many jurisdictions, both defamation and harassment are criminal acts. Fair use does not cover these acts, and neither does fair use cover the further use of any material adjudicated as harassment or defamation in a civil case. This is one of the reasons that congress here in America, is attempting to pass a cyber bullying bill...to make these criminal laws universal in the states.

I feel I must address another point you made a couple of comments ago about copyrighted material. If someone uses my content, for instance dubbing in their own audio or text, over my video. They have possibly used that content, to break the law, by harassing or defaming me. This may violate fair use, but has not been tested.

Brett filled the DMCA on straightd0pe's only video about him. I don't think that a single video can be viewed as harassment, I think it would take at least three. Defamation would require a "false" or "unjustified" attack on the character of a person. This, also, would not be the case in regard to straighd0pe's video.

I never watched the video in question in full, so I have no real idea of just what was said. Nor do I know BK's history. I'm just not that interested in that type of drama, rumors, accusations, or anything that doesn't affect me directly. Whether or not BK was defamed or not, is something the courts would have to decide, not me. People on the net can infer, claim, or insist, anything they want to, but without exact, verifiable evidence, I don't believe anything anyone says. Nobody should.

See the response I just posted above. I have long advocated that all who were banned prior to the new YT three strike rule be brought back without prejudice because the banning in the past was so arbitrary and capricious.

Apparently, they did allow Brett to come back but asshats with old grievances will not get off his case and just let him run a good channel. What absolute jerks!

Thank you for starting my afternoon with a laugh. I know you're a bit upset with everybody jumping on Brett's case lately. He is a very likable guy, and has done a lot of good for the non-Abrahamic community in the past few month.

I just can't help this feeling that this has all occurred before. Strike that... going back through the backlog of videos, I see way too much evidence that it has, to continue to ignore.
