It seems both 亱 and 夜 mean the exact same thing. I think they can be used interchangeably but not too sure about that. The only thing I'm sure about is that 夜 is used far more often. You can look up these characters on wikipedia but they both have almost identical definitions and usages.

Yes, 夜 can be written either way as the standard form. The writing of any Chinese character is passed down or rejected through centuries of writing styles, tastes and preferences. After it is accepted as the standard, people also may create their own handwriting, making it simpler or fancier as so called "calligraphy". Check the most current dictionary for standards is the best bet.
