First, the Declaration of Independence says, "All people are CREATED equal." And it is quite obvious: put however many naked newborn babies next to each other, and try to tell which is superior or inferior. None, of course.

But that's only true about babies, maybe children. After that, it's on merit.

You're actually agreeing with his point, because judges make their decisions based on a person(s) actions. They have to objectively judge the person(s) based on a set principle of rules.

Well, he was talking about equality as a principle, then appealing to holy books. So the book doesn't really matter that much. The issue is whether equality is right as a principle. I am adding a subtlety: it depends which kind of equality.

Actually, some religious books are not based on merit. The Tanakh (the Old Testament) establishes inequality based on descent. The Hindu scriptures do likewise, based on karma of past lives.
