That's the spirit! Only thing is, historically courts have not overturned the vote of the people. Putting it to the vote was the best thing that could happen. Gay and lesbians wanted the vote and they got it. Now they need to accept the results.

Just some info: Currently, the California Supreme Court is hearing arguments; not on the issue of marriage but the methodolgy of how the Proposition for the Amendment was introduced and passed. If in fact the method is legal, then as naggernutz said, "The people have spoken". The only possible recourse would be to demonstrate in another lawsuit, that the notion of a defintion of marriage to exclude any culture (unless the acts of that culture have been cited as illegal) is unconstitutional.

job discrimination/housing discrimination/hate crimes/marriage rights

No one has "redefined" any constitution except to ammend it to "redefine" marriage as between a man and woman. Most constitutions never mentioned gender until the last 10 years when propositions like Prop 8 changed the constitution. The conservatives are the ones "redefining" marriage in an effort to head-off same-sex marriage, which is often covered by equal rights clauses in state constitutions!
