Ultimately what happened here was that Danny got moved on through harrassment from public servants. And that's what Section 5 is all about. It's such an all encompassing tool and open to such broad interpretation that the police can threaten it's enforcement to deter.

The police can Require name and address where they have reason to believe a person has committed a road traffic offence, a 'relevant offence', a licencing offence, an act of anti-social behaviour or is in possession of a controlled drug. Section 5 or causing alarm distress and harrsement falls under ASB and relevant offence therefore in this situation "you were obliged" to give details as the complainent was clearly alarmed to call it in to the police.

@blessing786 I'm sure that what your actually refering to are acts and not law, an act is only usable should you consent to it such as giving your details. this can be found in blacks law dictionary. if you give your details then you are consenting to a contract and then are bound by its conditions.
Of course, nothing to stop the police saying someone made a complaint whether they did or not, which as I'm sure you know is just exactly what they do, do...

If those PO's believed he had committed a Section 5 offence, then why didn't they arrest him, let alone demand his details? At the end of the day its the officers discretion on how they deal with any incident. Google "justice holland megaphone" high court ruled that the behaviour of using a megaphone does not cause section 5.Section 5 says they must prove the words you are saying are "threatening words or behaviour likely to cause harrassment alarm or distress" so even if words cause harrassment alarm or distress they must be threatening. A threat is a "declaration of an intention or determination to inflict punishment, injury, etc., in retaliation for, or conditionally upon, some action or course"

The police can Require name and address where they have reason to believe a person has committed a road traffic offence, a 'relevant offence', a licencing offence, an act of anti-social behaviour or is in possession of a controlled drug. Section 5 or causing alarm distress and harrsement falls under ASB and relevant offence therefore in this situation "you were obliged" to give details as the complainent was clearly alarmed to call it in to the police.

@gurnstein Dude, you dont have to be arrested for very crime out there, you can be reported for summons hence the reason to require your details. At the end of the day its the officers discretion on how they deal with any incident. In this case the officers wouldnt need to stand infornt of judge as they are not witnesses the person who made the complaint is. If the officers had witnessed the incident then they COULD have arrested him. I hope that clears it uo.

You deny there request because there is No Law that states you have to give your details.
The police constantly claim you are infringing upon bylaws, Acts or Statutes.
However, these are not laws, they are the legislated rules of society. And you have the right to Not to Consent to them.
I would suggest that you read up on how to issue Torts against officers and go after them through their commercial liability, if they insist on kidnapping you.
