  • Well maybe if you would follow police instruction in the first place you would not have to go through that.

    Now, I don't agree with what happened to you and I'm sorry you had to go thorugh it but,

    You knew you had nothing to hide and should have stepped out of the car, they would search find nothing and sent you your way. Problem over.

  • Well if you think throwing the constitution out and letting law enforcement search whoever they want without a cause then yeah i guess theres no problem with that.

    If we waive our rights and let the govt question and search us without the right the problems are just starting. Give an inch they take a mile (or 100 in from edge of the US) and we'll just lose more rights and have more checkpoints and searches wanting to search innocent citizens who never crossed a border.

  • This makes me sick. They are nothing but sadistic animals overstepping their boundaries. I've already written to Sen. Kyl in Az. to look into this. I live in Az. and my daughter in San Diego, and now I fear for our lives traveling back and forth. These agents just did it to put fear in him, they enjoyed it too much. They should be fired.

  • "This was about retribution for his disobedience" this is what america has come to. we are now on the level of stalin's russia and hitler's germany. if we dont resist they will just keep taking. dont fool yourselves into believing we have a constitutional republic. we have to work to get it back.

  • This should not happen to ANYONE. We treat our animals better than prisoners in our care. This is the police state which we allowed to be put into place after 9/11. This is the result of spending billions to militarize a border with one of our biggest allies and trading partners. We have given up our rights for the illusion of safety. We allowed this to happen.

    I don't really like a lot of what the pastor preaches but he was wronged here and he should sue them all.

  • I think that both sides are wrong here. He raised huge red flags to the lawmen by 1) refusing to answer their questions when he was first stopped. 2) Refusing to allow his car to be searched. 3) Refusing to exit that car when asked? Why was he so uncooperative? But, Why did they taser him? Why did they slam him against the car? Why did they almost stand on his head?

  • "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated..." 4th ammendment

    He was refusing b/c the only reason they had to search his car is b/c the dog supposedly alerted. But nothing was ever found, and he said the dog never alerted, plus they didnt find anything in the car. It seems they either lied about the alert or it was induced.

    He was standing for his rights.

  • Also, if they really thought he had drugs i think they would have taken him out, searched and not found anyhting and let him go.

    This was about retribution for his disobedience, not about trying to catch somone smuggling drungs, if you think the amount of force used was excessive please call DPS and complain.

    No one is required to answer questions, this would only be a "reasonable suspticion" not probable cause u could have 1000 of those and not be able to search anyone.

  • That is talking about stops at the border:

    "Here, the seizure of respondent took place AT THE INTERNATIONAL BORDER. Since the founding of our Republic, Congress has granted the Executive plenary authority to conduct routine searches and seizures AT THE BORDER, without probable cause or a warrant..."

  • He was never entering the country at any time and was within the US for his entire trip. Even this case states that there is a difference-

    "...stopping and examining persons entering this country, the Fourth Amendment's balance of reasonableness is qualitatively DIFFERENT at the international BORDER THAN in the INTERIOR."

    He was never entering the country and was on the interior the whole time.

  • You would probably let the cops put an anal probe up your behind if they asked. I have no respect for servile, pathetic human beings who cower before authority. You don't understand your rights. Who are these so-called Americans who think you should do whatever a cop says - no matter how ridiculous, illegal or unwarranted. Try reading the US Constitution. It was written by people who understood all to well how dangerous unchecked government power can be.
