First off by invading it without having a valid reason, than by staying there after overthrowing the government, and especially by outsourcing jobs in Iraq to US contractors instead of the people of Iraq themselves. Iraq did not cooperate with the Treaty nor inspectors. Chemical weapons were found in the second war in bunkers though old. The ability to create them at a whim was there along with the chemist/scientists needed to do it.
