I just received a letter from Pressler & Pressler in reference to an old phone bill dating back to 2003. I recently moved back from Florida to NYC and received a phone call from Pressler in ref to the same bill, this time demanding 900+ dollars by end of day or the IRS would jump in. I never saw in any contract that a debt collector can freeze your bank account if you do not pay a credit card, mortgage, student loan , etc. I never saw that in any contract. Well maybe because the contract never really existed. Contract law is 1. OFFER 2. Acceptance (meeting of the minds) 3. Consideration (something in exchange for value. I just received a letter from Pressler & Pressler in reference to an old phone bill dating back to 2003. I recently moved back from Florida to NYC and received a phone call from Pressler in ref to the same bill, this time demanding 900+ dollars by end of day or the IRS would jump in. They did get me for an old CC dated in 1997 and took 900 from my account. I owed then an addtl 500 but they've never contacted me since. Weird? What should I do? These debt collectors must have the following documentation in court in order for the court to have jurisdiction or the judge is a criminal. 1. a legal enforeceable contract. (not a computer-generated copy of some BS debt) a contract that contains the signature of yours and not a copy or forged document. Pressler is good at forging your signature and making copies these jerks never have the original. 2. An affidavit of assignment from the original creditor. 3. An account ledger proving a loss.

I never received anything certified. Oh and I found out that I have another judgment from a different firm for like $300, unbelievable!, and ironically they used the same process server for the summons and talked to the same neighbor a year later....this doesn't make any sense. And who sues for $300? I don't see my lawyer till Thursday.

This judement is on file. I have to pick up the paperwork from the courthouse and meet with my lawyer. He is concerned about a couple of things. Most of their debts is past the statute of limitations. They are debt buyers. Meaning they donot buy your debt from the original creditor.
