If you have the guts to protest, please have the guts to have yourself covered by a backup sniper to take out vicious animals that seek to severely injure/murder you.
baton blows=internal injuries=chance of fatal injury
@DeutcherKonnig Wow dude, so you are saying the response to violence is an even more intense violence. Backup sniper? Too much COD? Rather than just hit them in the wallet by suing for abuse and such, lets just blindly shoot at cops, ya know, who are mothers and fathers, possibly even friends of some of the rioters. That's the answer! Second, the chance of a fatal baton blow with the wide grip is extremely low.
@Thehuntingwolf Any man that would violate another persons civil rights deserves a serious beat down at best and perhaps even a fatal blow. I rather just murder the shot callers, but anyone that sides with the shot callers likewise deserves to die.
Have you the same apparent sensitivity for the millions of Iraqi civilians that have been murdered by US & NATO? Man wants to serve tyranny should expect to die...also, his family. If that sounds harsh, so be it.
@DeutcherKonnig Civil rights? To illegaly assemble without a permit on private property of a university? Second yes. I served in Iraq. BUT, about 9/10 Iraqies love us. Saddam was "tyranny", not a few kids getting pushed back because THEY FORMED A RIOT! I understand shit is going to go wrong, but dont fucking stand in front of bull when you are given the opportunity to leave. And You don't shoot people. If you do that, it's war, and you WILL lose.
@Thehuntingwolf Consider the vet in Oakland that was beaten with batons and suffered a ruptured spleen. He was denied medical attention for nearly 20 hours and was near death. You have training with various weapons? Strikes to the head are considered "deadly force" in the police academy. (yes, I'm a cop and a national Jujitsu champion)
@DeutcherKonnig Yes I do. I have done 3 tours in Iraq as a detainee officer. I have used nearly every less than lethal weapon possible. Like I said and will continue to say (so rather than respond, Im leaving it here) mistakes happen, BUT THEY STARTED THIS! They were told no tents and they said Fuck You, police said leave, they said fuck you, police pushed, they said fuck you. Then shit happened, right or wrong, they had every opportunity to leave and do it right.
@Thehuntingwolf Unless you have interviewed all 50 million Iraq citizens, how can you surmise they "ALL" love the USA?? Over a million have been butchered. I highly doubt it. THe country functioned with modern infrastructure under Saddam, how are they doing now with DU everywhere and destroyed municipal services, Mosques and other buildings.

@DeutcherKonnig WHEN YOU SAY ALL WE HAVE TO DO IS FLANK THEM... YEAH THIS IS A WAR OF IDEAS
SO THEREFORE EDUCATION AND TRUTH IS THE ONLY WAY TO WIN A WAR LIKE THIS.
THEY CLAIM SOCIALISM/COMMUNISM IS BETTER - WHERE THE GOVERNMENT RULES THE PEOPLE AND WHERE THE PEOPLE HAVE VERY FEW RIGHTS!
THIS IS HOW THE NEW WORLD ORDER IS TRYING TO DEFEAT THE WORLD'S WESTERN NATIONS. . . THEY CAUSE THE ECONOMIC INSTABILITY THEN THEY ARE RIGHT THERE TO HELP PUSH THE US CONSTITUTION OUT THE DOOR
OWS supporters have now declared war on the USA and the American people. They are now threatening to burn down the entire city of NY with molotov cocktails. Looks like they are trying to drag us into a civil war. OWS supporters have turned into fullblown terrorist. Are we going to stand for these terrorists trying to take us down?
@FLIPPARAZZI hahah was that suppose to say something? guerillas please, you pry bought your weapons from the USA. So there are plenty more where they came from!
Occupiers have wasted weeks on nonsense when all the time they should have been protesting their wasted tax dollars and the fact that they should have been made a millionaire. Out of all the trillions Obama put the country in debt, he could have given every American 1 million dollars and made every American a millionaire and jump started the economy like it has never been done in history. Everyone would have been happy paying off their debts and buying whatever they needed.
Obama sucks, his first two years he had complete Democrat support from the house and senate but he did nothing but got our country in debt. Obama is a zero president. Clinton was a big success because he worked with both the Republicans and Democrats. Obama doesn’t want to work with anyone who is against destroying our country. Obama would have been a loved president had he taken 3 trillion dollars and made every American a millionaire.
George Hermann had police run him off of different city park benches where he was trying to get some sleep one night as a poor young boy.
So when he became a Houston multi-millionaire he donated land downtown for a park with the stipulation that people there be "undisturbed by the forces of law and order"
The City Attorney later ordered that people were not to be arrested for sleeping in the park
The Occupy Group has recently been staying in the park
@Loathomar The tents were not down. They were told that they could not put up tents, but did anyway. The police took down a few on the perimeter as a warning, which obviously didn't work. Then this happened when they moved in to take the rest down.
This video is doctored. The police did not force the #OWS protestors to leave. They merely air dropped job applications & help wanted ads onto the compound and the protestors all fled like cockroaches!
The police have left behind bars of soap as a deterrent to discourage any occupier from returning.
OCCUPIERS R WASTING THERE TIME!! OCCUPYING CITIES AND WALL ST DON'T EFFECT THE RICH ELITE'S. BANKS AND WALL ST IS WHERE THEY WORK, CEO'S COULD CARE LESS ABOUT WORK SPACES. THEY NEED TO OCCUPY WHERE THE RICH LIVES, IT'LL B MORE EFFECTIVE THEN A CITY. THE RICH IS AT HOME ENJOYING THERE WINE WHILE THE PROTESTERS FREEZE. THE RICH CAN CARELESS. WINTER IS COMING, ACT FAST. OCCUPY THE RICH NEIGHBORHOODS!! POVERTY IS THE MOST DANGEROUS KILLER IN THE WORLD. DON'T LET THEM WIN!
Jab the kids in the front with your nightstick....yeah that will move them all back. Dumb violent tactics used by the cops. Aren't they supposed to fight crime? Or is it civilians...who knows anymore.
@GlassAgate No, its not. Without question. You do realize that crowd control batons are made with stiffened foam, right? They're not standard issued night sticks...as for the pink slips - ya, don't hold your breath.
The question is, can the OWS movement morph into something that can get things changed, versus just calling attention to the problems. Just squatting in city parks does little in the end. They have changed the conversation, now they have to move it forward.
In two days, im going to cover my entire body in pillows, put knee pads up and down my legs, elbow pads all up and down my arms and im going to wear a biker helmet. I will be inthe front pushing police back im also very heavy, some peopel say im fat but whatever..anways police watch out because i am coming for you!
Scum bag pot belly pigs on power trips pfff. They ruin the reputation of all the real cops out there. Drug dealers in most major cities get more respect by the average person than the cops do these days. That pathetic fact shows you just how bad police have gotten over the last 30 years. 15 years from now the world will look back on this country and consider it worse than Nazi Germany. They will point to pictures of the police and say this was Americas version of the Gestapo.
Two things: First of all, those tents do present a public health and safety risk. Secondly, this is hardly draconian by any measure. In most countries (and civilizations in history), the government would have gone in with swords or machine guns.
@Genktarov Only health risk is to the people in the tents who choose to be there. If you can't choose to live in a tent with a slight health risk then you don't live in a free society. Yes you are right in most countries the crack down would have been worse. Exactly the reason these people are out there doing this.... So we don't incrementally evolve to that point.
I really wanted, at 2:10 or so, the one flamingly gay cop to stand up and say "I don't HAAAVE any children, sister!" and just start swinging his baton like a dancer.
And now I'm confused, granted I don't know what I actually wanted the last half of my comment to mean. I think I was just shitting on republican buzzwords.
@hellfirdragon17 Otherwise people were going to set up tents on a public green. Shantytowns are a bastion of crime and sickness. It's a public health and safety hazard.
@Genktarov wow. You've no idea do you? Occupy movements are setting up tents for a purpose. But you'd have to get the movement to understand the purpose.
The government needs more money so they can help us. The government loves you and we need to tax those greedy people, and give that to the government. We should trust our dear leaders like Obama to help us.
"@youbestbequiet" maybe you should go and look up where the so-called Federal Reserve get their money from before you show your total lack of knowledge here.
@tonycodolo You don't have a fucking clue what a police state is like. The fact you call the country with the most gun ownership rights in the free world a police state is laughable. Go home kid, dinner is getting cold, tell your mom I said what's up.
@metalslugxBTB I look at it like this (1) I have a home to go to to have dinner & (2) I know who my mom is. By my thinking I am at least 2 points ahead of the game than you. But hell what do I know, I cann't get FOX TV where I stay.
LOL Just run these retards over. Pepper spray and bullets will disperse there morons. They are the 99%, yeah the 99% of this Country that doesn't pay taxes or know the bill of rights. I vote for law enforcement to go in and clear them out, with or without force is fine by me.
@Jthom88 LOL You are the ignorant fuck lol These dumbasses don't know anything about the Constitution and to even think they have anything to do with freedom just shows how mentally challenged you are. Go bury your head back in the sand you waste of space.
Those students are as ignorant as you are. Our Supreme Court has established that local governments CAN issue "time, place, or manner" restrictions on public speech and assembly. Such restrictions must be "content-neutral" and serve a legitimate government interest. A restriction on setting up tents and overnight camping is well within the law and does not violate our Constitution. The constitutional rights of those students were NOT violated.
@krag30 clearly you feel that all ruling of the Supreme Court have been constitutional, right? Lets review some rules of the past Supreme Court; Dred Scott v. Sandford - Slavery is constitutional, Plessy v. Ferguson - segregation is constitutional, United States v. Cruikshank - State have the right to ban any and all groups from owning guns. Japanese-American internment camps where constitutional meaning no right to trail for US citizenry... You agree that all these views are constitutional?
@Loathomar So your stance is that right to free speech trumps all other civil rights? With that logic, I can threaten to kill you. I can threaten to bomb a preschool. Hell, how about I steal my neighbors car, paint political propaganda all over it, crash it through the window of Walmart and set up permanent residence in the camping and housewares section. Afterall, I have a right to speak my mind as long as "I" think I have a legitimate grievance and a right to air it, right?
@jennh911 Threatening to kill me or bomb something does not fall under free-speech there are even libel and slander laws. Personal attack on non-public figure are reasonable restricted, but political speech is not "I will kill you" can be illegal but "All Liberal/Jews/Muslims/Conservative/ect must die" is protected. And I have never claims the 1st Amendment trumps property rights, so your car and Walmart are safe. But public land is a very different question.
@krag30 Not only were their rights not violated, they were given a great deal of flexibility by the very UC system they were protesting considering it was the UC's property they were trespassing on.
@jennh911 As they where all students of the UC, they have the right to be on US property until expelled from the school. And as the school is publicly owned, they school does not have the right to ban political protests, as political protests are constitutionally protected free speech/ free assembly and petition the Government for a redress of grievances.
@Loathomar Not sure where you got your info, but no they do not. The protest was not banned - they were simply told they could not CAMP there or set up CAMP. That's why they were removed. As students, they agreed upon entry to adhere to the UC Policies and Regulations. The school property is owned and governed by the school and is protected under the policy. h t tp://students.berkeley.edu/uga/regs.stm -- see sections 321 (a,g,m and n) -- 331, 332, 340, 341, etc.
@Loathomar And for the record, the school allowed them to protest around the clock even though they were violating UC policy (see manual that I posted) -- but were strictly warned that camping, tents, etc. would NOT be permitted and the policy would be enforced if they ignored the warnings. The students started setting up camp anyway and the University made good on their warning.
@jennh911 And this makes the beating of peaceful students OK, how? It the cops took the tents and left, it would be just fine, but there was no reason for violence by the cops.
@Loathomar That's an entirely different point than the one you were making. You said they had a "right" to be there and were protected by their first amendment. They weren't. In terms of police force, they weren't there to "take tents". They were ordered there - by the University - to remove trespassers. While it appears that they were "beaten" - they were resisting arrest and refusing police orders. Like it or not, they were committing misdemeanors.
@jennh911 The student paid for the right to be on campus, and it has been ruled by the courts that students have the right to protest on all public school. As often is the case the school often have unconstitutional rules in there rule books that would likely be thrown out if taken to court (a 2007 survey found the 75% of college rules where not in line with court ruling on protest). Banning students without a hearing from the campus would be grand larceny by the school.
@Loathomar Im just making the point that the students did NOT have a right to be there, they were breaking the law, the police were required to take action - they resisted. And, given my extensive background in police procedure and criminal law - I'm just saying that police had a right to use force, and that one should not assume they know what they're talking about based on a youtube clip. Its unfortunate all the way around.
@jennh911 Student absolutely have the right there, even more so by the statement you give from the school that said "the school allowed them to protest around the clock" and school rules that go against that are in direct violation of the constitution and the supreme court decisions Tinker v. Des Moines Independent Community School District. The tents did not have the right to be there. But the tents where taken before the beating started.
Once the tents where down, students where within the rule of law and the rule of the school, as the beating took place after, it is simply assault. It is like the police want to tow your car, you try to stop them and the hit you while you where trying to stop them, OK. But, when you car is gone and they start to beat you because the tell you to leave when you have the right to be there, it is not OK, it is assault. Not excessive force, but police beating people who where commit no crime.
@Loathomar Also, the tents were not removed prior to police response. Only a few perimeter tents were removed. Your example makes no sense. My objection for a towed vehicle isn't a crime. Trespassing and resisting arrest are. If I was under arrest in conjunction with the tow, and I talked back and refused to put my hands behind my back, you better believe they would take me down physically - and charge me with resisting.
@jennh911 If you try to stop your car from legally being towed, it is clearly a crime. And student that where being beaten where not trespassing and resisting arrest, nor where they braking the law or even school rules. The cops had the right to get to the tent, but there was no tent in the video behind the people they where beating. this was just an abuse of power on a peaceful group of protectors and you should be ashamed for standing up for them.
@Loathomar I'm not ashamed for explaining proper police procedure and how it could easily be misinterpreted by the average civilian watching YOUTUBE. I'm voicing an opinion supported by a background of expert level experience. You don't have to agree, but frankly, you do not know what you're talking about in terms of law enforcement. The UC called for the police to remove the students, not the tents. Cops are not simple code enforcement. They weren't called there to remove tents.
@jennh911 If they where called in to remove the students and not the tents then they where in violation of the US Constitution and the supreme court. They had the right to remove the tents, but never the right to beat unarmed peaceful protests. And maybe the students needed to "take the beating", as it is better to beat physically hurt then give out your constructional rights. But there is no way the police where ever in the right when beating unarmed peaceful protesters.
@Loathomar And you are correct - if you stand in front of a car being towed by an officer, you are guilty of obstructing. If that officer then informs you that you are under arrest for it, and you continue to act belligerent regardless of where the car is...then resist him, he will physically take you down to detain you. Locking arms and refusing to clear an area after being ordered is resisting. You dont have to agree with it, but its a fact.
@Loathomar Just a side note - not sure if you were aware, but riot control batons are made of tactical foam. They're not standard issued night sticks. While it may appear excessive on a youtube clip, it may not have been. A striking motion to the crowd is used to push the crowd back, but that doesn't mean the club had an excessive impact to the body even if it looks that way. This explains why there were minimal injuries reported.
@jennh911 The police where not in full riot gear and as I reviewed the vid, I saw no sign of foam batons. There have been reports of injuries, thought the fact the the police are dragging their feet on the official injury report of students is, by no mean surprising. People are generally not hospitalized for internal injuries or even cracked ribs, but because they was no major external injures and no one hospitalized, it is just fine to beat peaceful protesters?
@Loathomar I never worked for those agencies, however, unless they are the only ones still using standard batons, those were crowd control batons. Had they been night sticks, we would have absolutely seen broken bones, etc. Officers typically carry asps. But I digress. Lets leave it as, "peaceful" and "excessive force" are subjective terms depending on your point of view and agree to disagree. Lets hope tonight's events don't lead to further injury - to students, civilians, or officers.
@jennh911 Did you see anything that was not peaceful about the protests? I sure didn't. Excessive force is subjective. As if that did, what the did it to a drug dealing murder who ran, I wouldn't say anything, but these where peaceful protesting college students, which btw is all the police force does (UCPD not city PD) it is entirely unreasonable. Violence by the police should really only even be used either to protect the police or protect other people.
@Loathomar UCBPD handle a wide range of calls for service. Crimes in progress, cold reports, etc. They don't "just" handle protest control. Most of the officers seen in this particular clip were not UCPD, anyway. BPD has the reputation for being some of the most tolerant/non-conservative officers in the bay area and screen their officers as such.
@Loathomar They have the right to be there as long as they adhere to campus regulations. WHICH INCLUDES THEY CANNOT CAMP ON CAMPUS PROPERTY. Regardless, it's not the responsibility of local law enforcement to refer to out of state case law before taking action re: in progress crimes - and its not their responsibility to determine if a blatant penal code violation would stand up in court. If the students want to file suit - let them. And one example of case law from Iowa doesn't mean they'd win.
@jennh911 The lawsuit is already filed in court. The fact that a few tents where setup does not mean any but a few protesters broke any rules. Could the police show beyond a reasonable doubt that anyone there setup the tents at the protest? The fact that the law treats police as if they where entirely immune from the US 95% of the time, is not a case to what the did was right to remotely constitutional. When the police murder people then cover it up, they get a few month in jail if that.
See the Jose Guerena shooting, or Tony Arambula or Joseph Erin Hamley or Kelly Thomas or Marvin Booker... ect, ect... There is not one of these case or the hundreds like it that if done by anyone other then a police officer would not have lead to a 20+ year jail sentence... But the most the police get is 90 days in jail for the murder of a mentally disabled man who was shot died by the police while lying supine on the ground. Any one else would have got murder 1 and the death penalty.
@youbestbequiet The federal reserve is a privet bank that charges interest on all money made. It's a corporation. It's not really federal at all. Look it up.
@pmodrat And? The Fed Reserve should have been abolished long ago but they are not the one who voted for bailouts. LOL Do you have any idea what these retards are even doing? They surely don't.
@youbestbequiet They print money for the banks for like 1 %. In the 80's they had to try to get people to put money in the banks and sometimes I got as much as 10 %, They don't need our money, only our debit. If things keep going like this they will always need bailouts. And we the people will be left having to pay for it with interest. Every country in the world has the same system owned by the same hand full of stock holders. And the very few that do not, we want to blow up ( Libya, Iran ).
@pmodrat Again, The Fed did not authorize bailouts lol So you are anti capitalism in general I see. Maybe consider a move to China or Cuba if you can't cut it in this Country. The Fed should be gone, I agree but people like you vote for Obama or Rinos who will never even audit the Fed so stop your whining. Back to the protesters aka homeless, try protesting the right place...DC LOL
@youbestbequiet No not anti Capitalism. 55 thousand Americans died in Vietnam to stop communism. But Our government loves to let the bone heads in America buy their junk. We seem to build our next enemy up every time(China). We fight Al Qeada, But help them run Libya. After WW1 Germany was busted into the ground. But in a short time our banks helped build their war machine back up. The world corporate central banking system is our government. Has been since 1913.
@pmodrat Agreed, our govt props up dictators and then we kill them when they no longer serve our purpose. Our Govt is as corrupt as the ones we make claims against. That's why I am saying these people are protesting the wrong people. Greed and Capitalism is great but corruption isn't and that is DC, not Wall or Main street.
police is the private Army of the rich & ruling class paid for by the American taxpayer. The police will do anything that their Masters ask them to do. Police are armed & retarded they will hurt you & enjoy doing it. They get pleasure of out killing people. The more police we have more crime we have because they create laws to make criminal out of anyone. Because of all the military equipment that the police received from the Army, police R the extension of the US Army to hurt US citizens..
@KYKIN44 ...because an anarchist state would be so much more peaceful and effective. Your post has got to be one of the most ignorant and uneducated posts I've seen to date, completely void of any logic or fact. And that says a lot.
Those police officers were using necessary force to protect themselves from a crowd violently pressing against them. And police officers CAN use necessary force to ensure compliance with their commands. The police were there, not to deny anyone free speech, but to remove several tents in an area where camping is not permitted. Those so-called protesters were attempting to physically prevent police from doing their job. Those police officers showed amazing restraint and self-control.
The American Gestapo, being trained for keeping the order when the NWO takes over completely. What Dark Days lay just ahead for the USSA and the world as the globalist ramp things up.
I feel for the policemen and policewomen in this country that go out day after day and deal with the ignorant losers of our society. Thank you for what you do clean them up and out we are behind you.............the real Americans
I speak for the 99% of Americans who are sick and tired of this whole 'occupy' movement,....the cops should use clubs, pepper-spray, rubber bullets, dogs, water cannons, and if necessary, lead bullets, to get these losers out of our public parks, and back in their mothers basement, where they can live out their miserable existence without bothering us REAL Americans.....
I am the 51%. The 51% who dont blame others for their shortcomings. The 51% who dont riot in the streets when THEIR life didn't turn out how they thought it would. The 51% who go to work everyday, not wanting the government to 'help' them, but to only stay out of their way. The 51% who are to busy in their life to 'demonstrate' or 'occupy'. I am the 51% who get nothing from the government, and wouldn't have it any other way. The 51% who are still proud to be an American
i call for "riot protector army" build up, what u say?An army to protect againt thos riot police...some crazy dudes using the same tatics as they are since its not violence why not...

Obama would have been a loved president had he taken 3 trillion dollars and made every American a millionaire.
sadieaugust 3 months ago
George Hermann had police run him off of different city park benches where he was trying to get some sleep one night as a poor young boy.
So when he became a Houston multi-millionaire he donated land downtown for a park with the stipulation that people there be "undisturbed by the forces of law and order"
The City Attorney later ordered that people were not to be arrested for sleeping in the park
The Occupy Group has recently been staying in the park
DillonDee1 3 months ago
@Loathomar The tents were not down. They were told that they could not put up tents, but did anyway. The police took down a few on the perimeter as a warning, which obviously didn't work. Then this happened when they moved in to take the rest down.

This video is doctored. The police did not force the #OWS protestors to leave. They merely air dropped job applications & help wanted ads onto the compound and the protestors all fled like cockroaches!
The police have left behind bars of soap as a deterrent to discourage any occupier from returning.

Two things: First of all, those tents do present a public health and safety risk. Secondly, this is hardly draconian by any measure. In most countries (and civilizations in history), the government would have gone in with swords or machine guns.
Genktarov 3 months ago
@Genktarov Only health risk is to the people in the tents who choose to be there. If you can't choose to live in a tent with a slight health risk then you don't live in a free society. Yes you are right in most countries the crack down would have been worse. Exactly the reason these people are out there doing this.... So we don't incrementally evolve to that point.

youbestbequiet 3 months ago
@Jthom88
The constitutional rights of those students were NOT violated.
krag30 3 months ago
@krag30 clearly you feel that all ruling of the Supreme Court have been constitutional, right? Lets review some rules of the past Supreme Court; Dred Scott v. Sandford - Slavery is constitutional, Plessy v. Ferguson - segregation is constitutional, United States v. Cruikshank - State have the right to ban any and all groups from owning guns. Japanese-American internment camps where constitutional meaning no right to trail for US citizenry... You agree that all these views are constitutional?
Loathomar 3 months ago
@Loathomar So your stance is that right to free speech trumps all other civil rights? With that logic, I can threaten to kill you. I can threaten to bomb a preschool. Hell, how about I steal my neighbors car, paint political propaganda all over it, crash it through the window of Walmart and set up permanent residence in the camping and housewares section. Afterall, I have a right to speak my mind as long as "I" think I have a legitimate grievance and a right to air it, right?
jennh911 3 months ago
@jennh911 Threatening to kill me or bomb something does not fall under free-speech there are even libel and slander laws. Personal attack on non-public figure are reasonable restricted, but political speech is not "I will kill you" can be illegal but "All Liberal/Jews/Muslims/Conservative/ect must die" is protected. And I have never claims the 1st Amendment trumps property rights, so your car and Walmart are safe. But public land is a very different question.
Loathomar 3 months ago
@krag30 Not only were their rights not violated, they were given a great deal of flexibility by the very UC system they were protesting considering it was the UC's property they were trespassing on.
jennh911 3 months ago
@jennh911 As they where all students of the UC, they have the right to be on US property until expelled from the school. And as the school is publicly owned, they school does not have the right to ban political protests, as political protests are constitutionally protected free speech/ free assembly and petition the Government for a redress of grievances.
Loathomar 3 months ago
@Loathomar Not sure where you got your info, but no they do not. The protest was not banned - they were simply told they could not CAMP there or set up CAMP. That's why they were removed. As students, they agreed upon entry to adhere to the UC Policies and Regulations. The school property is owned and governed by the school and is protected under the policy. h t tp://students.berkeley.edu/uga/regs.stm -- see sections 321 (a,g,m and n) -- 331, 332, 340, 341, etc.
jennh911 3 months ago
@Loathomar And for the record, the school allowed them to protest around the clock even though they were violating UC policy (see manual that I posted) -- but were strictly warned that camping, tents, etc. would NOT be permitted and the policy would be enforced if they ignored the warnings. The students started setting up camp anyway and the University made good on their warning.
jennh911 3 months ago
@jennh911 And this makes the beating of peaceful students OK, how? It the cops took the tents and left, it would be just fine, but there was no reason for violence by the cops.
Loathomar 3 months ago
@Loathomar That's an entirely different point than the one you were making. You said they had a "right" to be there and were protected by their first amendment. They weren't. In terms of police force, they weren't there to "take tents". They were ordered there - by the University - to remove trespassers. While it appears that they were "beaten" - they were resisting arrest and refusing police orders. Like it or not, they were committing misdemeanors.
jennh911 3 months ago
@jennh911 The student paid for the right to be on campus, and it has been ruled by the courts that students have the right to protest on all public school. As often is the case the school often have unconstitutional rules in there rule books that would likely be thrown out if taken to court (a 2007 survey found the 75% of college rules where not in line with court ruling on protest). Banning students without a hearing from the campus would be grand larceny by the school.
Loathomar 3 months ago
@Loathomar Im just making the point that the students did NOT have a right to be there, they were breaking the law, the police were required to take action - they resisted. And, given my extensive background in police procedure and criminal law - I'm just saying that police had a right to use force, and that one should not assume they know what they're talking about based on a youtube clip. Its unfortunate all the way around.
jennh911 3 months ago
@jennh911 Student absolutely have the right there, even more so by the statement you give from the school that said "the school allowed them to protest around the clock" and school rules that go against that are in direct violation of the constitution and the supreme court decisions Tinker v. Des Moines Independent Community School District. The tents did not have the right to be there. But the tents where taken before the beating started.
Loathomar 3 months ago
Once the tents where down, students where within the rule of law and the rule of the school, as the beating took place after, it is simply assault. It is like the police want to tow your car, you try to stop them and the hit you while you where trying to stop them, OK. But, when you car is gone and they start to beat you because the tell you to leave when you have the right to be there, it is not OK, it is assault. Not excessive force, but police beating people who where commit no crime.
Loathomar 3 months ago
@Loathomar Also, the tents were not removed prior to police response. Only a few perimeter tents were removed. Your example makes no sense. My objection for a towed vehicle isn't a crime. Trespassing and resisting arrest are. If I was under arrest in conjunction with the tow, and I talked back and refused to put my hands behind my back, you better believe they would take me down physically - and charge me with resisting.
jennh911 3 months ago
@jennh911 If you try to stop your car from legally being towed, it is clearly a crime. And student that where being beaten where not trespassing and resisting arrest, nor where they braking the law or even school rules. The cops had the right to get to the tent, but there was no tent in the video behind the people they where beating. this was just an abuse of power on a peaceful group of protectors and you should be ashamed for standing up for them.
Loathomar 3 months ago
@Loathomar I'm not ashamed for explaining proper police procedure and how it could easily be misinterpreted by the average civilian watching YOUTUBE. I'm voicing an opinion supported by a background of expert level experience. You don't have to agree, but frankly, you do not know what you're talking about in terms of law enforcement. The UC called for the police to remove the students, not the tents. Cops are not simple code enforcement. They weren't called there to remove tents.
jennh911 3 months ago
@jennh911 If they where called in to remove the students and not the tents then they where in violation of the US Constitution and the supreme court. They had the right to remove the tents, but never the right to beat unarmed peaceful protests. And maybe the students needed to "take the beating", as it is better to beat physically hurt then give out your constructional rights. But there is no way the police where ever in the right when beating unarmed peaceful protesters.
Loathomar 3 months ago
@Loathomar And you are correct - if you stand in front of a car being towed by an officer, you are guilty of obstructing. If that officer then informs you that you are under arrest for it, and you continue to act belligerent regardless of where the car is...then resist him, he will physically take you down to detain you. Locking arms and refusing to clear an area after being ordered is resisting. You dont have to agree with it, but its a fact.
jennh911 3 months ago
@Loathomar Just a side note - not sure if you were aware, but riot control batons are made of tactical foam. They're not standard issued night sticks. While it may appear excessive on a youtube clip, it may not have been. A striking motion to the crowd is used to push the crowd back, but that doesn't mean the club had an excessive impact to the body even if it looks that way. This explains why there were minimal injuries reported.
jennh911 3 months ago
@jennh911 The police where not in full riot gear and as I reviewed the vid, I saw no sign of foam batons. There have been reports of injuries, thought the fact the the police are dragging their feet on the official injury report of students is, by no mean surprising. People are generally not hospitalized for internal injuries or even cracked ribs, but because they was no major external injures and no one hospitalized, it is just fine to beat peaceful protesters?
Loathomar 3 months ago
@Loathomar I never worked for those agencies, however, unless they are the only ones still using standard batons, those were crowd control batons. Had they been night sticks, we would have absolutely seen broken bones, etc. Officers typically carry asps. But I digress. Lets leave it as, "peaceful" and "excessive force" are subjective terms depending on your point of view and agree to disagree. Lets hope tonight's events don't lead to further injury - to students, civilians, or officers.
jennh911 3 months ago
@jennh911 Did you see anything that was not peaceful about the protests? I sure didn't. Excessive force is subjective. As if that did, what the did it to a drug dealing murder who ran, I wouldn't say anything, but these where peaceful protesting college students, which btw is all the police force does (UCPD not city PD) it is entirely unreasonable. Violence by the police should really only even be used either to protect the police or protect other people.
Loathomar 3 months ago 3
@Loathomar UCBPD handle a wide range of calls for service. Crimes in progress, cold reports, etc. They don't "just" handle protest control. Most of the officers seen in this particular clip were not UCPD, anyway. BPD has the reputation for being some of the most tolerant/non-conservative officers in the bay area and screen their officers as such.
jennh911 3 months ago
@Loathomar 3:58 "we're gonna come to your fucking house and beat your children"
theroguefight 1 month ago
@Loathomar They have the right to be there as long as they adhere to campus regulations. WHICH INCLUDES THEY CANNOT CAMP ON CAMPUS PROPERTY. Regardless, it's not the responsibility of local law enforcement to refer to out of state case law before taking action re: in progress crimes - and its not their responsibility to determine if a blatant penal code violation would stand up in court. If the students want to file suit - let them. And one example of case law from Iowa doesn't mean they'd win.
jennh911 3 months ago
@jennh911 The lawsuit is already filed in court. The fact that a few tents where setup does not mean any but a few protesters broke any rules. Could the police show beyond a reasonable doubt that anyone there setup the tents at the protest? The fact that the law treats police as if they where entirely immune from the US 95% of the time, is not a case to what the did was right to remotely constitutional. When the police murder people then cover it up, they get a few month in jail if that.
Loathomar 3 months ago
See the Jose Guerena shooting, or Tony Arambula or Joseph Erin Hamley or Kelly Thomas or Marvin Booker... ect, ect... There is not one of these case or the hundreds like it that if done by anyone other then a police officer would not have lead to a 20+ year jail sentence... But the most the police get is 90 days in jail for the murder of a mentally disabled man who was shot died by the police while lying supine on the ground. Any one else would have got murder 1 and the death penalty.

I haven't seen anything like this since the Vietnam war protests.
I'm so proud of our young people putting themselves on the front line to better the world.
