Rather than just hit them in the wallet by suing for abuse and such, lets just blindly shoot at cops, ya know, who are mothers and fathers, possibly even friends of some of the rioters. That's the answer! Second, the chance of a fatal baton blow with the wide grip is extremely low.

  • @Loathomar The tents were not down. They were told that they could not put up tents, but did anyway. The police took down a few on the perimeter as a warning, which obviously didn't work. Then this happened when they moved in to take the rest down.

  • Two things:  First of all, those tents do present a public health and safety risk. Secondly, this is hardly draconian by any measure. In most countries (and civilizations in history), the government would have gone in with swords or machine guns.

    Those students are as ignorant as you are. Our Supreme Court has established that local governments CAN issue "time, place, or manner" restrictions on public speech and assembly. Such restrictions must be "content-neutral" and serve a legitimate government interest. A restriction on setting up tents and overnight camping is well within the law and does not violate our Constitution. The constitutional rights of those students were NOT violated.

Sandford - Slavery is constitutional, Plessy v. Ferguson - segregation is constitutional, United States v. Cruikshank - State have the right to ban any and all groups from owning guns. Japanese-American internment camps where constitutional meaning no right to trail for US citizenry... You agree that all these views are constitutional?

Personal attack on non-public figure are reasonable restricted, but political speech is not "I will kill you" can be illegal but "All Liberal/Jews/Muslims/Conservat­ive/ect must die" is protected. And I have never claims the 1st Amendment trumps property rights, so your car and Walmart are safe. But public land is a very different question.

  • @krag30 Not only were their rights not violated, they were given a great deal of flexibility by the very UC system they were protesting considering it was the UC's property they were trespassing on.

  • @jennh911 As they where all students of the UC, they have the right to be on US property until expelled from the school. And as the school is publicly owned, they school does not have the right to ban political protests, as political protests are constitutionally protected free speech/ free assembly and petition the Government for a redress of grievances.

  • @Loathomar Not sure where you got your info, but no they do not. The protest was not banned - they were simply told they could not CAMP there or set up CAMP. That's why they were removed. As students, they agreed upon entry to adhere to the UC Policies and Regulations. The school property is owned and governed by the school and is protected under the policy. h t tp://students.berkeley.edu/uga­­/regs.stm -- see sections 321 (a,g,m and n) -- 331, 332, 340, 341, etc.

  • @Loathomar And for the record, the school allowed them to protest around the clock even though they were violating UC policy (see manual that I posted) -- but were strictly warned that camping, tents, etc. would NOT be permitted and the policy would be enforced if they ignored the warnings. The students started setting up camp anyway and the University made good on their warning.

  • @Loathomar That's an entirely different point than the one you were making. You said they had a "right" to be there and were protected by their first amendment. They weren't. In terms of police force, they weren't there to "take tents". They were ordered there - by the University - to remove trespassers. While it appears that they were "beaten" - they were resisting arrest and refusing police orders. Like it or not, they were committing misdemeanors.

  • @jennh911 The student paid for the right to be on campus, and it has been ruled by the courts that students have the right to protest on all public school. As often is the case the school often have unconstitutional rules in there rule books that would likely be thrown out if taken to court (a 2007 survey found the 75% of college rules where not in line with court ruling on protest). Banning students without a hearing from the campus would be grand larceny by the school.

  • @jennh911 Student absolutely have the right there, even more so by the statement you give from the school that said "the school allowed them to protest around the clock" and school rules that go against that are in direct violation of the constitution and the supreme court decisions Tinker v. Des Moines Independent Community School District. The tents did not have the right to be there. But the tents where taken before the beating started.

  • Once the tents where down, students where within the rule of law and the rule of the school, as the beating took place after, it is simply assault. It is like the police want to tow your car, you try to stop them and the hit you while you where trying to stop them, OK. But, when you car is gone and they start to beat you because the tell you to leave when you have the right to be there, it is not OK, it is assault. Not excessive force, but police beating people who where commit no crime.

  • @Loathomar Also, the tents were not removed prior to police response. Only a few perimeter tents were removed. Your example makes no sense. My objection for a towed vehicle isn't a crime. Trespassing and resisting arrest are. If I was under arrest in conjunction with the tow, and I talked back and refused to put my hands behind my back, you better believe they would take me down physically - and charge me with resisting.

And student that where being beaten where not trespassing and resisting arrest, nor where they braking the law or even school rules. The cops had the right to get to the tent, but there was no tent in the video behind the people they where beating. this was just an abuse of power on a peaceful group of protectors and you should be ashamed for standing up for them.

  • @Loathomar I'm not ashamed for explaining proper police procedure and how it could easily be misinterpreted by the average civilian watching YOUTUBE. I'm voicing an opinion supported by a background of expert level experience. You don't have to agree, but frankly, you do not know what you're talking about in terms of law enforcement. The UC called for the police to remove the students, not the tents. Cops are not simple code enforcement. They weren't called there to remove tents.

They had the right to remove the tents, but never the right to beat unarmed peaceful protests. And maybe the students needed to "take the beating", as it is better to beat physically hurt then give out your constructional rights. But there is no way the police where ever in the right when beating unarmed peaceful protesters.

  • @Loathomar And you are correct - if you stand in front of a car being towed by an officer, you are guilty of obstructing. If that officer then informs you that you are under arrest for it, and you continue to act belligerent regardless of where the car is...then resist him, he will physically take you down to detain you. Locking arms and refusing to clear an area after being ordered is resisting. You dont have to agree with it, but its a fact.

While it may appear excessive on a youtube clip, it may not have been. A striking motion to the crowd is used to push the crowd back, but that doesn't mean the club had an excessive impact to the body even if it looks that way. This explains why there were minimal injuries reported.

  • @jennh911 The police where not in full riot gear and as I reviewed the vid, I saw no sign of foam batons. There have been reports of injuries, thought the fact the the police are dragging their feet on the official injury report of students is, by no mean surprising. People are generally not hospitalized for internal injuries or even cracked ribs, but because they was no major external injures and no one hospitalized, it is just fine to beat peaceful protesters?

  • @Loathomar I never worked for those agencies, however, unless they are the only ones still using standard batons, those were crowd control batons. Had they been night sticks, we would have absolutely seen broken bones, etc. Officers typically carry asps. But I digress. Lets leave it as, "peaceful" and "excessive force" are subjective terms depending on your point of view and agree to disagree. Lets hope tonight's events don't lead to further injury - to students, civilians, or officers.

As if that did, what the did it to a drug dealing murder who ran, I wouldn't say anything, but these where peaceful protesting college students, which btw is all the police force does (UCPD not city PD) it is entirely unreasonable. Violence by the police should really only even be used either to protect the police or protect other people.

  • @Loathomar UCBPD handle a wide range of calls for service. Crimes in progress, cold reports, etc. They don't "just" handle protest control. Most of the officers seen in this particular clip were not UCPD, anyway. BPD has the reputation for being some of the most tolerant/non-conservative officers in the bay area and screen their officers as such.

  • @Loathomar They have the right to be there as long as they adhere to campus regulations. WHICH INCLUDES THEY CANNOT CAMP ON CAMPUS PROPERTY. Regardless, it's not the responsibility of local law enforcement to refer to out of state case law before taking action re: in progress crimes - and its not their responsibility to determine if a blatant penal code violation would stand up in court. If the students want to file suit - let them. And one example of case law from Iowa doesn't mean they'd win.

  • @jennh911 The lawsuit is already filed in court. The fact that a few tents where setup does not mean any but a few protesters broke any rules. Could the police show beyond a reasonable doubt that anyone there setup the tents at the protest? The fact that the law treats police as if they where entirely immune from the US 95% of the time, is not a case to what the did was right to remotely constitutional. When the police murder people then cover it up, they get a few month in jail if that.

  • See the Jose Guerena shooting, or Tony Arambula or Joseph Erin Hamley or Kelly Thomas or Marvin Booker... ect, ect... There is not one of these case or the hundreds like it that if done by anyone other then a police officer would not have lead to a 20+ year jail sentence... But the most the police get is 90 days in jail for the murder of a mentally disabled man who was shot died by the police while lying supine on the ground. Any one else would have got murder 1 and the death penalty.

  • Those police officers were using necessary force to protect themselves from a crowd violently pressing against them. And police officers CAN use necessary force to ensure compliance with their commands. The police were there, not to deny anyone free speech, but to remove several tents in an area where camping is not permitted. Those so-called protesters were attempting to physically prevent police from doing their job. Those police officers showed amazing restraint and self-control.
