If Bush wasn't afraid to get Congressional approval of his nutjobs, the judges wouldn't have to be involved. She voted for the PATRIOT ACT reauthorization, but this US attorney provision was slipped in after the vote (BTW, my source for that is James Sensenbrenner's own statement). This language was never voted on by any reps or Sens, except the few Repubs who were in the conference committee.
