Most of the time when someone like Phil gets in trouble, there are jealous people waiting in the wings to assasinate his character. You might not like the man personally, but one has to separate the man from the incident. For as many times he pulled guns out, he never killed anyone before, which might indicate he never intended to kill anyone in the first place. He was showing off and making a spectacle of himself, but if you play with guns, sooner or later someone's gonna get shot.
