  • I believe u have Ur case law misunderstood. If he stops u from freedom of movement it does not mean Ur under arrest. It means Ur being detain. But he does need PC to have u detain which I didn't hear u say why he stopped u.

  • @lpi223: Police do not need probable cause to detain a person. Reasonable and articulable suspicion of criminal activity is enough to detain a person a few minutes while the officer asks a few questions. But as I understand Edward Lawson's history, he was often detained far longer, and sometimes jailed for not proving his identity.

  • Sir, you need to drive around problem areas, with your nice cars, and dress as u are in this vid. But now have some hidden cameras in your car to show the masses the extent of the profiling and lying they do. I'm not saying set them up. They will set themselfs up. Most officers act like they are the law and not upholding laws put forth by their peers. I would love to see some of those videos go viral. Not to educate the public, but to educate law enforcement.

  • Looks like they pulled you over without probable cause. Did you file a civil lawsuit?

  • Note that in California, you do NOT have to produce an identification card even if arrested. You can just give them your right thumbprint. See California Penal Code 835.5.

  • Scape goating on (for the most part) innocent citizens is not a character any person, especially a law enforcement officer, should possess. Those officers volunteered to do their job, which includes a lawful duty to serve and protect. It, however, does not include the right to target, criticize, patronize, and scape goat on people "just because they had a bad day at work."

The cop says - whoops - no reason to have stopped this guy. I better charge him with something. Arrested. Jailed. Let go. Guy goes to court. The District Atty. does not show up. No charges filed. Just a Sheriff Deputy harassing another citizen for no cause.

  • This guy in the video is also not a fan of a prior California I.D. law. It took this guy 8 years in California and Federal Court. In 1983 he won in the U.S. Supreme Court. The California I.D. Law was declared unconstitutional. This guy won the right for U.S. citizens to be free from being stopped while walking and being asked for I.D. by cops.

  • The Supreme Court decision (658 F.2d 1362) struck down an old version of California Penal Code 647(e) (not to be confused with CPC 647e).

    That old PC 647(e) was replaced by one that basically said that if a person was loitering in a manner that a reasonable person would conclude was suspicious of criminal activity then the person must identify himself if asked (as opposed to producing an identification card).

    But PC 647(e) has changed again! Now it concerns "lodging" without permission.

  • @EdLawsonTV: I checked the Bill that removed the original PC 647(e). That bill just removed the section, and reordered the subsequent sections. So the new PC 647(e) is the old PC 647(f). (I had told Ed this 2 years ago in a private message. This posting is just for the record.)
