In January, 2012, a law went into effect that prohibits California residents from openly carrying a firearm. Now the only way to carry is to get a concealed permit...which discriminatley issued. California sucks.
Not bad, yes, everything seems to be routine for American police officers. Here in Germany the open carrying of a firearm is also allowed, provided you own a gun license, but it is still undesirable. Therefore in this country may be in part the gun loaded, so tube filled magazine. Nevertheless, an inspection should look at us a little bit different, as is the otherwise quiet German police very nervous.

I bet the cops were pressured to show up do something simply because this was being recorded by a TV station. Obviously they want to get across the message that while you are within your rights, you may also be stopped by police for questioning as well... which a vast majority of people do not want to deal with. @ZzRvXzZ Only 4 states allow concealed carry without a license, 28 states allow open carry without a license. For those of us who want to carry but don't want to spend the money/time it takes to get a concealed carry permit, open carry is free and legal. As for the cop, you're part right, CA law requires people who open carry to submit to checks of the weapon to ensure it's unloaded, however, the law does not allow for a check of the serial number or making the man stand against the wall.
As a rule, cops don't know much law. They know obvious violations (ie) speeders, seat belts, public intoxication etc. Actual law.....not so much. They also have enjoyed the weapon advantage and physcological edge of carrying.... that civilians have failed to exercise in the past. Open cxarry is new to them. They either don't know the law; or will ignore it to discourage open carry. When cops ignore (break) this law; it should be reported and followed up on. As cops say "IT"S OUR LAW."

That police officer treated a law-abiding citizen like a criminal. I would have gotten his badge number and name, then filed a complaint. Not for any money, but so his superiors would educate him on the right to open carry so this doesn't happen again.

They didn't request you identify yourself at first, or ask for ID, but that would have precluded the disarmament and unlawful harassment. As they know you, if they would have ID'd you first, then they should treat you as a friendly, not a foe. It appears cops are living in a world of "us" and "them", and you are the "them". Incorrect.....the serial number, in plain view can be checked, called plain view doctrice.
What you miss is this....a police officer can detain someone based on reasonable suspicion...ie reasonable suspicion that a person carrying a semi auto handgun with a magazine in the well is in violaition of 12031(a) PC. During a lawful detention an officer can confirm ID and dispel or confirm their suspicion. Records can be checked as long as it does not prolong the detention

The officer did not respect these rules. What if by a freak accident the gun had been loaded and when he was handling it it went off, he would have shot himself. Also the officer shouldn't have been checking the gun with both the magazine and gun in his had. He could have easily slipped. He may have not held the gun with his firing finger on the trigger but he still swept his body with the gun. Why not simply avoid all this and carry Concealed. No one needs to know I have a firearm on. When the LLEA gets a call they must respond and check it out. They are watched all the time as seen on this recording. Part of this is a SHOW put on by them for the locals that call when they see a Gun. This does not go on if you carry concealed.

Even if you agree with California's search to check if the weapon is loaded. (which I believe is a violation of the fourth amendment)
In such a case, the officer is limited to the suspected reason for the search and cannot legally compel the person to answer questioning of anything else.
The serial number has nothing to do with the reason for the search (loaded status) and therefore checking the serial number is a violation of the law.

Detaining the person in order to check it, or detaining the person while the officer takes the time to write down the serial number is. The officer did not violate the open carry law. If the officer chooses to run the serial number of the weapon after the person walks away... he can.

For those of us who want to carry but don't want to spend the money/time it takes to get a concealed carry permit, open carry is free and legal. As for the cop, you're part right, CA law requires people who open carry to submit to checks of the weapon to ensure it's unloaded, however, the law does not allow for a check of the serial number or making the man stand against the wall.

As a rule, cops don't know much law. They know obvious violations (ie) speeders, seat belts, public intoxication etc. Actual law.....not so much. They also have enjoyed the weapon advantage and physcological edge of carrying.... that civilians have failed to exercise in the past. Open cxarry is new to them. They either don't know the law; or will ignore it to discourage open carry. When cops ignore (break) this law; it should be reported and followed up on. As cops say "IT"S OUR LAW."

I say that one should be able to get a permit to carry a concealed loaded gun, thus avoid the searches that a conspicuous open carry gun presents itself.
Obviously, with a concealed gun carry, comes a greater responsibility and effort to use care and caution with respect to the use of the gun, if necessary.

They didn't request you identify yourself at first, or ask for ID, but that would have precluded the disarmament and unlawful harassment. The cop in the video showed very clearly that he's an asshole that wants 100% control over all situations and is just inches from snapping if someone flinches too much in his vicinity.
MANY other officers have handled the same situation WITHIN the law and not been a dick about it.

When this was all done the guy should have demanded that he have the right to check the cops gun. Why not? You say he is a cop and citizens can't check cops and treat them as they treat us. Who made all these stupid silly rules anyway? If you grabbed a cops gun and checked it he would murder you on the spot but we as peaceful law abiding citizens have to put up with this communist treatment.

Incorrect.....the serial number, in plain view can be checked, called plain view doctrice.
What you miss is this....a police officer can detain someone based on reasonable suspicion...ie reasonable suspicion that a person carrying a semi auto handgun with a magazine in the well is in violaition of 12031(a) PC. During a lawful detention an officer can confirm ID and dispel or confirm their suspicion. Records can be checked as long as it does not prolong the detention

@nebula25x The LEO never had his finger on trigger. He did have it sweep his own body but no real danger. An empty gun pretty useless. No violation here. Simply a check it is what the LLEA does respond to the paranoid locals. This is why CCW is a better idea.

2:Never let the muzzle cover anything you are not willing to destroy.
The officer did not respect these rules. What if by a freak accident the gun had been loaded and when he was handling it it went off, he would have shot himself. Also the officer shouldn't have been checking the gun with both the magazine and gun in his had. He could have easily slipped. Yes the run was unloaded but that does not mean the rules no longer apply.

If it had been loaded it would not have been a freak accident? And the LEO would have unloaded it and the gun owner would have been in trouble Nothing more here. As I said NO FINGER ON!!!!

@Sigp229TRT When he is inspecting it you can see the fingers of his support hand (left hand) rest inside the trigger guard. He may have not held the gun with his firing finger on the trigger but he still swept his body with the gun. Also I didn't mean that the gun being loaded was the freak accident, I was referring to the gun going off by some freak accident.

Why not simply avoid all this and carry Concealed. No one needs to know I have a firearm on. When the LLEA gets a call they must respond and check it out. They are watched all the time as seen on this recording. Part of this is a SHOW put on by them for the locals that call when they see a Gun. This does not go on if you carry concealed.

Even if you agree with California's search to check if the weapon is loaded. (which I believe is a violation of the fourth amendment)
In such a case, the officer is limited to the suspected reason for the search and cannot legally compel the person to answer questioning of anything else.
The serial number has nothing to do with the reason for the search (loaded status) and therefore checking the serial number is a violation of the law.

Detaining the person in order to check it, or detaining the person while the officer takes the time to write down the serial number is. The officer did not violate the open carry law. If the officer chooses to run the serial number of the weapon after the person walks away... he can.
