This officer followed protocols. The officer does not have to show the speed. If he wants to argue to case that is what "Court" is for. In the state of Utah, if you refuse to sign a citation then you are to be arrested and brought immediately before a judge so that you're not a flight risk. Most states have the same law. The trooper was going to arrest the driver for refusal to sign. The driver did not comply after the trooper gave him instructions. Technically the trooper did nothing wrong, however, he could have told him he was going to jail for refusal to sign. Trooper did the right thing. Trooper was cleared, I know for sure

A taser is less than leathal. A taser can be used at anytime to affect an arrest. It would be the same if pepper spray was used. The taser is used to gain compliance. Now, I do believe this officer was a bit over board. Not sure what the laws are in Utah but used to in most states if a person refused to sign a citation, it was a misdemeanor offense.

Thought Tasers were to be treated just like a hand gun or any other fire arm (deadly and to be treated with the utmost care and careful usage), and to be used as a last line of defense in the event the officer or the surrounding public was in immediate life threatening danger.

Massey did sue and he got 40K, but it was because the cop used incorrect procedure in removing the barbs of the taser. The actual use of the taser was found to be justified based on Massey's actions.

You can be arrested for not signing a summons. The officer was too quick to arrest and tase. He could have informed the driver that if he did not sign the ticket he would be arrested. Instead, the driver refused to sign the ticket and was told to step out of the car and was placed under arrest. The driver clearly did not understand the consequences of refusing to sign a summons. The officer was justified but should have WARNED the driver of the consequences before SHOWING him.

@TheSteveGibson I can tell right away from your question that you are not in law enforcement. The answer is NO, the force used by an officer is upped by one level above the threat. The "Use of Force Matrix" which dictates this is used by a lot of departments. As far as refusing to sign a citation, YES you can be arrested for failure to comply with a lawful order.
The man was asked repeatedly to stop and turn around by the officer. not to mention he started reaching in his pocket as he approached the side of the car. At that point the officers life was in potential danger and he had the right to even use Lethal force. This man better be glad he chose non-lethal force.

Signing a citation is not an admission of guilt. There is no reason to not obey the officer's commands when he tells you to sign a ticket. You argue over the ticket in court, not on the side of the highway. When an officer tells you to do something, you shouldn't turn away and dig into your pockets. An officer has no way of knowing your intentions. The taser is not a lethal weapon and was merely used to regain tactical control over the situation. I see nothing wrong with this.

In the state of Utah, if you refuse to sign a citation then you are to be arrested and brought immediately before a judge so that you're not a flight risk. Most states have the same law. The trooper was going to arrest the driver for refusal to sign. The driver did not comply after the trooper gave him instructions. Technically the trooper did nothing wrong, however, he could have told him he was going to jail for refusal to sign. Trooper did the right thing. Trooper was cleared, I know for sure

2. The cop should if just hangcuffed him but not taser him.

While I agree the tasing may have been excessive use of force, this was a smart-ass kid who had no respect for the law and lawful orders. I also sense this officer was on a power trip especially the "taser ride" comment to the other officer. Still it's best to just sign the ticket and fight it in court, not on the side of the road.

Cops are not the judicial branch, they are simply enforcing the laws. The place to fight this would be in court, not by the side of the road. A taser is less than leathal. A taser can be used at anytime to affect an arrest. It would be the same if pepper spray was used. The taser is used to gain compliance. Now, I do believe this officer was a bit over board. Not sure what the laws are in Utah but used to in most states if a person refused to sign a citation, it was a misdemeanor offense.

@Epic562 No, reading his rights had nothign to do with it and the case was not dismissed. Massey paid the fine. Miranda rights are only if you want to use someone's words against them in court. they have nothing to do with arresting anyone. that's only in Hollywood.
Massey did sue and he got 40K, but it was because the cop used incorrect procedure in removing the barbs of the taser. The actual use of the taser was found to be justified based on Massey's actions.

You can be arrested for not signing a summons. The officer was too quick to arrest and tase. He could have informed the driver that if he did not sign the ticket he would be arrested. Instead, the driver refused to sign the ticket and was told to step out of the car and was placed under arrest. The driver clearly did not understand the consequences of refusing to sign a summons. The officer was justified but should have WARNED the driver of the consequences before SHOWING him.

@TheSteveGibson I can tell right away from your question that you are not in law enforcement. The answer is NO, the force used by an officer is upped by one level above the threat. The "Use of Force Matrix" which dictates this is used by a lot of departments. As far as refusing to sign a citation, YES you can be arrested for failure to comply with a lawful order.

The trooper in the case was justified in Tasering the suspect. After displaying unprovoked contempt and not following the officer's detention instructions the suspect then turned around and attempted to re-enter his vehicle. This is the very point where many police officers lose their lives as suspects go for weapons.
There is no time for an officer to second guess the suspect's intention. The girl didn't help the situation any and is lucky she didn't get zapped too.

Really-- all he had to do was sign the bloody ticket. He's not admitting to guilt so no biggie, just contest it in court-- maybe the cop won't show and depending on the jurisdiction you can plead down to a lessor charge. On the other hand, sign or go to jail? LAME.... Do the tax payers really need to pay for this kind of crap?

Signing a citation is not an admission of guilt. There is no reason to not obey the officer's commands when he tells you to sign a ticket. You argue over the ticket in court, not on the side of the highway. When an officer tells you to do something, you shouldn't turn away and dig into your pockets. An officer has no way of knowing your intentions. The taser is not a lethal weapon and was merely used to regain tactical control over the situation. I see nothing wrong with this.

Comon.. That wasnt much force. In a way the guy was asking for it. He didnt comply and started walking back towards his car with his hands reaching toward his pockets. If you've ever seen vids on youtube of when cops were shot its when shakey situations like this went down. Sure your probably saying he didnt even do anything, but if you were in the troopers shoes you'd be nervous and most likely would do the same.

These folks must be from California... where you're required to answer all the driver's questions to their satisfaction before being allowed to politely ask for them to please sign the ticket. And if any of your answers are not met with the driver's approval, then you have to apologize to them and let them drive away.

@poyntman yeah...no. Not at all. He has no legal obligation to sign a citation. The officer had no right arresting him without reading him his miranda rights. This officer was completely wrong in this situation, the taser was a bit much.

Compliant to what?? The only authority this "officer" has is lethal and non-lethal weapons, without them he has zero authority. And factually, he has no grounds or basis to use aggression or forced compliance for a non-crime (crime = damage, injury, redress ability)

@SkylarkGSX Clearly spoken by someone who has no clue how the justice system works. The side of the road is no place to hold court. If he had a problem with the 40mph sign, he could have addressed that in a proper venue (court). It's not rocket science...if an officer gives you verbal commands, and you don't comply, stand by to get tased, pepper sprayed, or thrown down to the ground. Perhaps you should watch Chris Rock's skit "How not to get your ass kicked by the Police).

@fhp2b If a cop asked you to do something against the law, like say, kill you wife or kid, I bet you'd do it so as not to get tased. You can always go to court to find out the officer was wrong.
