The judge ruled that being gay himself doesn't create a conflict of interest when a judge rules on gay marriage laws. Prop 8 should have been evaluated to see if it's valid or not based on the constitution before it went out there and take effect. But it's ok, it makes religious fanatics look bad..really bad. Religion IS dangerous in the wrong mentality.

Just like the Jim crow laws were unconstitutional, the supreme court ruled them unconstitutional although the people voted the law in. you can't have a law in the constitution that conflicts with laws in the constitution. thats why you have the judiciary branch look over the laws to see if they are constitutional and in this case it wasnt. the people can still appeal this and they will, so the people have/had and will always have power.

It doesn't matter what the will of the people is when it comes to breaking the Constitution. WTF are you talking about? This wasn't just a report, it WAS A DECISION. Based on the AMERICAN CONSTITUTION. Which, BTW, overpowers any state constitution. Also, the state Constitution from what I read didn't have anything about gay's not being allowed to marry, nor any other minority. What it did allot for is homosexuals to still adopt children, which was the big poof in the first place. Which means the whole case for Prop 8 was MOOT.
