@metafact But he's also correct that this law is not enforced. Adultery is a criminal offense, of the minor misdemeanor type, in many states. But if it's brought to the attention of the police they will not find enough grounds to file an indictment. Or if they do, the court will dismiss it. So Mr. Stern's claim that this part of the law (article 255 in the NY penal law) has been updated recently and still left unchanged doesn't mean that it's a law that is applied. It's not applied.
