Basically
The two guys were eye witnessess that confirmed the girl was the most passive and peaceful of the group. The attacker claims he just pushed her out of the way, where in fact they saw him punch her in the face, cut the corner of her eye.
Later on its alleged that the NYP offered to charge the atacker, though she was unable to press charges as by giving her name here, it would jepordise the safety if relatives in Iran.
