  • No. They aren't using the domain to profit off any trademarks you own so the answer is, you lose. You aren't the first person to desperately want a domain that someone else owns, you won't be the last one to have a tantrum and accuse them of 'cybersquatting' for beating you to the punch. No need to pay a lawyer. This is a clearly settled issue. You can file a UDRP ($1500) and try to take it away, but you have to prove bad faith of the registrant. Remember when mom said life isn't fair? Welcome.

  • Are you Donald S Monopoli? If not you are out of luck. Here is the Trademark. If you are you may have a shot at getting the domain, though the mark was just filed in early December.

    trademark serial: 85491141 (uspto.gov)

    Though, Donald S Monopoli could in turn get in trouble with TerraBrite (two 'r') as they have had a trademark since 2009.

    trademark serial: 77714964

    The names are too similar.

  • Nobody likes a "squatter", which is a person that infringes on a TRADEMARKED domain (Coke, Apple, etc). If you have a Trademark then you certainly have a case and I would suggest taking action. If however you suddenly want a domain that someone else owns then you have to pay for it just like people pay for land, homes, etc. It's digital real estate. There has been a whole industry around domain names for a long time. You can always file a UDRP or WIPO to have a impartial jury decide on the case.

It was put in effect in 2009 if that is what you were referring to? Just as many laws are signed in to law many years ago and are still valid today. Same concept here. Please refer to the ICANN website to review the UDRP so you can understand what we are referencing. Thank you

  • I believe you can only "force" them to give it to you or take it down if you have Terabrite registered as a trademark, and then possibly only if you registered it before they claimed the domain name. otherwise you'll probably just have to buy it from them. Other actions might be available if they are actively phishing or trying to scam your viewers by impersonating you.

  • They don't scam you. They are smart and want your money. It's a business idea and it is not illegal because you are not a registered business and you didn't originally have rights to that domain. They buy domains to make a profit it's a smart idea and you accuse people of being scammers because you didn't buy the domain when you should have?   • @NewProductions its called domain squatting, which the basic idea of is to make people who have intentions of truly using the site rather than buying it, and milking money out of people. Its not per-say illegal, but its wrong, and as he explains they put it up for bid for a high price, and bid before its gonna close to keep it going until it reaches an un-realistic amount. Its not 'buisness', its just low-lifes, and theyre not butching their name, theyre not a real buisness

  • Just for clarification, it is a type of intellectual property violation. Basically, you can sue them for stealing your intellectual property.

  • I know that if you have a legitimate product with a certain name, and a website that doesn't have a legitimate product is using a domain name which is the same as your product, if you can prove to a judge that it causes consumer confusion the domain name will be stripped from the other owner and given to you. I do believe you must buy the contract off of them, though. Which would probably be like 10-100$. But you would have to pay that to get the domain in the first place anyhow.

SO Either they have done it, or some hackers have! I suggest that you maybe contact a lawyer, and just ask some questions. Because you can get in trouble when other people are hacking them. Sad, but true.. THey are the one who's scamming

  • Well, since terabrite is not trademarked or considered a legitimate company (it would be a legitimate small business only if you have declared it on your taxes with proof of spending and product) then you cannot demand it to be forcibly taken down. However, you did not give them permission to use your image so you can demand them take off your image from the site. If you want trademark your name! so this would not happen. Please DO NOT promote any hacker activity that might incriminate you.

That is why Apple has the right (and they use it LIBERALLY) to take down any website that has iPhone in the title: iphone4s, iphonecam4s, iphoneporn4s and porn4iphones. Et cetera. It is because iphone is the intellectual property of Apple, and the argument for consumer confusion is a pretty easy case: Porn hurts Apples image, and using Apple IP gives these sites an advantage at the expense of Apple.

  • That happened to my friends band, they made a facebook book, YouTube , etc then someone made a website that was complete bull, so they called someone iforget who and then they contacted the scammers and they ended up paying my friends band money

  • In my opinion there is no way to get the domain legally, as far as you haven't registered a trademark for terabrite. At least thats what it works like in Europe.

    Just wait for the new gTLD domains that are coming in 2013 and get terabrite.music or something like that. If you really want the terabrite com domain, you will need to discuss a price with the current owner

  • @VleraBrite understand, but I guess that's the only way to get the domain without spending lots of money on attorneys or registering a legal trademark. if you hold a trademark for the name, it should be easy to get your domain name, as long as you can prove, that they are not actually doing any business under the name of terabrite. thats at least my experience (had a similar problem with a domain once), the US law is significantly different to the one here in germany, though

  • (2/2) - Is to offer some free downloads etc on your terabritemusic website to increase traffic and increase the search ranking on google. I think this is your best bet. I do not want to sound like i am being nasty, but there is very little reason for most people to go to your website. Free downloads, a forum, exclusives etc! Hope i have helped in some way.

The only person who is going to want to get this domain and use it properly is you. If their aim is too make money, then your the only person who will pay them. As much as it sucks, if you think your band will continue to grow (it looks like it will) you might be aswell trying to get a deal done now! Unless they are asking for alot!

I would wait for a few days and see how this goes, someone might have a sound solution (doubt it) then id figure out how much your willing to pay (figure out how much the guy has paid then add some on top) make an offer. If he declines, you need to go forth with terabrtiemusic or as someone mentioned above, register as trademark so you can register to get a domain with a valid reason before public! anyway, good luck and keep the good vids and music!

  • DJ, I've done courses in Business law etc for the UK (however, i can tell the same applies to you, most likely). Im saying this as to avoid you wasting your time with (trademarking etc (well for this purpose anyway). You would have a claim if they were ripping your band off. I.e. like a fake ticket site company etc. However, they are not. Example; Four year strong. They have some serious legal backing as a band (Universal Recs) and still have to use another domain. My suggestion to you (1/2)

    You can definitly file it for scamming because if they sell something thats not real [i saw they do, do ads] they are theives.

    You can also continue to contact them, let them know that you know theyre scammers, and basically bluff them into selling it to you [but thats blackmail & slightly illegal] I dont know much on this, so Id go with the first option...

  • I think you can only claim a domain without buying it from the current owner, is when you have the name registered somewhere. If they do illegal stuff, you can report them, so the domain will become free. Good luck! :)

  • @SommerV2 I agree with DJ on this, the "company" that has that domain name is malicious to the roots, the sole purpose of the company, which is not called terabrite, just grabs domains as fast as they can hoping that one day someone will pay them to obtain it. Like DJ said, as soon as DJ made the myspace they grabbed the domain. What they do is morally wrong and DJ and Sabrina deserve that domain, just give Terabrite (the fake company a call) see what kind of business they provide

Finally a lady picked up the phone and asked my name and phone number and I refused and said I just have a few questions about their business. She then interrupted me and said hold on I am going to transfer you to Robert CLICK The phone rang and it went to an answering machine. We called back again hoping to get the lady again and the phone line is now disconnected. >.<

  • @JerseyLeems There's no requirements for any domain extension, apart from .gov afaik. I had a *.org domain once, with no trouble what so ever. I own several *.com domains and I would certainly not see them be stolen by people who think they deserve them more than I.

Secondly, I CAN see it's wrong to take a domain, to resell it - no matter the circumstances. I do believe they should be prevented from selling it - but they are STILL the owners of the domain. Nothing changes - and TeraBrite (Band) should not be able to force TeraBRITE (FakeFirmLLC) to give them their domain.

I feel like it's wrong, that you are so determined to get this domain, when it is not yours. I haven't been able to find on their website, where it says: "domain name for sale".

  • @SommerV2 Exactly, that is why it is illegitimate. As I explained in the video, what these website squatters do is buy domains that are getting a lot of search results (usually people checking to see if it's available) grab the domain, wait for someone to put a backorder on it, when it comes time for the domain to expire they then start an auction for it and bid on it last second when you think you won increasing the price by HUGE amounts each time.

  • @SommerV2 The auction is just what goes on in Domain sites if more than one person backorders, and I'm pretty sure it's not legal if they are backordering their own domain to start up the auction themselves rather then just renewing it. This has nothing to do with SEO, our website ranks way better than the TeraBrite site already. There are just some people that don't even search it and just type it straight into the address bar and immediately assume we don't have a website. >.<

If you know the story about TeraBrite, it wasn't even a band at the time it was just what we decided to call the page for our first song "No One Knows" and we made a Myspace page for it like any other band as a joke pretending that we were in a band. We should be able to start a band without paying money as high school kids. End of story

  • @cvcaproductions We have been thinking about pointing VleraBrite to the TeraBrite website for sure, but that still wouldn't change the fact that some really scammy looking website is confusing a bunch of traffic that comes from us and pointing them in the wrong direction. Before we got TeraBriteMusic ranking well and when we got our initial boost of traffic from YouTube, TeraBritedotcom was ranking extremely well on alexa for all the wrong reasons. It's not right!

  • @VleraBrite Well, hopefully you can think of something to get that name, without costing to much. VleraBritedotcom might help direct traffic away from it, but never know. It is hard and sucks, that just anyone can get a domain then take it, to make money off of it, in that way, when they don't have much use for it, other than try and profit off of it only, for someone that can use it in a legit way, like yourselves.
