Doing a "Let's Play" showing content from a copyrighted video game (even if it's from 20 years ago) will be a criminal act. Posting "how to" videos explaining the operation of copyrighted software will become a criminal act.
F--k SOPA, and f--k this ridiculous attitude of the RIAA and MPAA that they need to go after people simply for having a song faintly playing in the background. It's the same logic as going after someone for taking a picture of themselves somewhere, say, Times Square, and because there was a billboard of a product or a company logo, suing them for it or telling them they have to photoshop it out. SOPA is so broad that it will affect pretty much everything we do on the internet. Welcome to China.
Everyone here knows Universal is rich as shit. There are other people who are doing wayyy worse things to cost them money. It's okay though because Universal will do the stupid thing and target a middle class family. They obviously don't know that you're allowed to put up to 30 seconds of a song on here. If they were smart they'd have this baby help them advertise!
@therealhardrock Yes! There are plenty of places online that will help you contact your representatives and draft your note to them. Please please please fight for your First Amendment rights!
In law class we are doing this case. Unfortunately I am on the universal side, but you totally have the right of fair use. I just can't believe big corporations have the nerve to make other people's lives complicated. You could barely hear the song. Ugh universal
Glad to see your video is still up! I'm writing a report on fair use and copyright pertaining to the internet, and I cited EFF on the story of how this video got wrongfully removed. I hope more YouTubers can learn from you and how we need to fight back against false claims made by companies like Universal. Keep fighting and I hope your son becomes a good lawyer someday! :)
I came here after reading about the lawsuit, and I have to say you are my hero.
Thank you for sticking up for our right to fair use. I know the copyright companies are losing money, and it's too bad for them, but I really don't like all my favorite AMVs being taken down because of copyright issues. If I really like the song, I'll buy it anyway. And btw, your son is really cute =).
The case involved Stephanie Lenz from Pennsylvania, who had made a home video of her 13-month-old son dancing to Prince's song "Let's Go Crazy", and posted the 29-second video on YouTube. In June 2010, Viacom's lawsuit against Google was rejected in a summary judgment, with U.S. federal Judge Louis L. Stanton stating that Google was protected by provisions of the Digital Millennium Copyright Act. Viacom announced its intention to appeal the ruling. Thats why Prince dont wanna his music on YT!!!
Why did he sue them? Really? I think that's pathetic. It's a video of a baby basically with something in the background! You can't even tell if that is a song anyways.
It is so garbled you can hardly tell what it is - and they wanted take down! How many people have home videos and the family sits around to watch with music int he background. They want to sue every person on the planet. You can't make music and release it and except people not to use it like this! Madness.
@Nintendog140 Your original comment ("Prince deserved to sue you.") was an incorrect statement. This comment is also incorrect. The lawsuit is Lenz V. Universal.
yes i know my username is unapropiate but this is me and my friends account and my friend kinda went ahead and she is really wierd and she just made up a username we are new to youtube we do not have a video camrea or a phone that takes videos so we will only be commenting i just wanted to let everyone won now so there woudlnt be a big commotion about it thxs
I got the feeling the issue was with Universal, not Prince himself. And to think I almost went and bought that song when I can now listen to it for free here!!! I am joking of course.
We're talking about this case in my Internet Law class in Law school, and so I had to come check out the video. This is Fair Use if ever there was such a thing. Kudos on holding tight to your principles, even though it meant the hassle of litigation! You're a true crusader of free society.
Oh boy, this is a cute video but I really don't get Prince and his actions. To me it was a fan playing music in the background while her baby danced. He's seems selfish.
So, this is THE famous (or should I say "infamous"?) video that had aggrivated "copyrightholders", huh? Tsk! They just want to sue for more money! The "music" is barely audible! And it's only 30 seconds long! Stupid lawyers and their stupid lawsuits! They should where on another suit! Just trying to sound like Francis from Left 4 Dead: "I HATE lawyers!"

@drtyrell969 so i guess you can say the same thing about Metallica aswell ecause they were the first to do what Prince did. lol, I can't even hear the song LOL!, Prince and your lawyers are nutz ... lol! I guess they are testing the waters to see how far they can take a law suit ...
So this is the video that lead to the change in how the entertainment industry handles fair use.
Amazing. Videographers and 95% of youtubers have this legal case to thanx. Just heard about this case on a legal podcast from august 2008 "video and Law Podcast".
What I don't understand is how stupid people are. We are allowed to post a minimum of 30 seconds of a song that is for a large audience without the need for permission to use.
Cute baby btw. Lol, my nephew goes crazy when he hears music and starts jumpin and dancing. I just feel sorry for the people below us....
The government is killing the internet as you know it, people have to look around more often and watch what they are losing, they are taking away rights fast, creating problems so you go running to them and they are killing the net and replacing it with one of there own for reasons of control.
Welcome to Nazi Germany fokes, before you know it you'll be either a good little robot with no freedoms or locked in chains or worse.
Whats sad is its true regardless of who denies it.
I don't see Google/YouTube as villains here. They have no interest in taking things down that they don't have to. They were doing what the DMCA requires. If anything, it is to their advantage to encourage the posting of the kind of copyrighted stuff that is permitted if accompanied by advertising. In any case, there's nothing in it for them to take things down if they don't have to.
@rhsimard Just not true, free thinker's run all over the net, people connect and information is traded, you may take this for granted but not everyone does, people are getting informed, they are launching there own controlled internet and killing the free one we have now.
You have to do one thing, understand that what you think are reasons they do things is actually just a simple bs story they make up as a cover, i don't say this lightly, a cover is so you don't know what they are really doing.
@rhsimard Google is actually a government controlled business which is really wrong because they have no business doing that.
Tyranny is on its way and its people who are falling for everything that is said that lead to how the Nazi's got in power, that is a fact, same tactics.
They are absolutely villains they even target people they don't "like" if you spout the truth about the government, they label you and go after you .. either right away or in time.
What else is amazing is, why the hell would UMPG be troubled by this tiny fragment of a song that is so hollow-sounding because of the way it's recorded, much less with people commenting in the foreground? How can this be unfairly competing with the actual record? Come ON!
Anyone else see the irony in this happening to a song called "Let's Go Crazy"?
It wasn't Prince himself; it was his publisher and copyright holder Universal Music Publishing Group that issued the DMCA takedown. Whether or not Prince personally approved or not, I doubt if he was involved, given how UMPG and other similar outfits are scouring the net for more opportunities to be ass***** in this same fashion.
The EFF took up the case. You can find the gory details at their website. Search for "dancing baby".
@SlimeTron5000 Wrong. The issue of copyright and Fair Use will only intensify as Google (YouTube), together with the movie and music industries, abuse us further.
@TheBilly You misunderstood. I did not declare copyright control 'dead', I know that copyright control is intensified for self-interest and monetary intentions.
I'm a big Prince fan, as u can see by my user name. But, Prince is being a total ass here, it's not like someone posted unreleased song, or a song from one of his concerts, or a bootleg song. It's "Lets Go Crazy" from Purple Rain, playing in the backround. It's not like someone is going to say, damn! I love that song, hadn't heard that in a while, let me download a 29 second backround version of it.
I finally got to watch this! Your baby was very talented. I'm sure he's about 3 or 4 now, am i rite? LOL Thank God u were able to get the vid back up, i saw on the news about what happened. Prince is a jerk...great artist, but a jerk
@edenza I did not realize that. I had not even heard about all of this until yesterday when I read that Prince said that the internet is basically done. Well, good luck with everything--cute kids. My 8 year old daughter and 3 year old son watched the video over and over again and loved it.
@marvchomer Thanks. My kids (now 6-almost-7 and 4 1/2) like to watch it when I pull it up(usually to view a comment or video response) except that Holden says he doesn't like "that noise."
@marvchomer yeah, Prince says the internet is 'basically done'.. but keep in mind that the man is mentally ill. To call him a rich eccentric is being mild, he does not comprehend things like you or I do - a lot of creative geniuses are not entirely normal upstairs.
Cute video--let me get this straight--Prince tried to sue to take this video off? What a scum bag. He should be happy people are still listening to his music and the new generation is dancing to it.
@marvchomer What happened, in a nutshell, is that I received a takedown notice from YouTube stating that someone had flagged my video as being infringing under the DMCA. I filed a counternotice saying that my video was not infringing. Six weeks later YouTube reinstated my video and I sued UMG for filing the false takedown notice. I'm the plaintiff in the lawsuit, which is a mistake many people make ;)
I guess he is just doing that to make extra money. he doesn't care about people dancing to it, just as long as he gets a few extra bucks each time people use his music.
lets get stupid lets bring more attention to the video wow 30 hits before prince wanted it taken down now over 1,00,000 way to go ... you can hardly hear the music anyway
Thank you so much for suing Universal Music and making them realize that their overzealous tactics went too far in stifling free speech and fair use! Let's Go Crazy!
Wow, it's unbelievable a take-down was issued over just that!
*ALL* music has some aspect of prior art about it, so essentially copyright holders are STEALING music 'ideas' from OUR culture, yet these greedy miserable bastards STILL want total, exclusive and ultimate rights over everything they do!
Well damn them! We really do need to stand up and fight these ridiculous and outrageous laws so we can hang onto the few remaining vestiges of our culture and community. Thanks for fighting it.
@edenza Fantastic. I, like many people, found this video through the copyleft / creative commons pipeline. Supporters of EFF and all that. Thank God Viacom just lost to YouTube. I wish you all the best
@tigerrose110203 I get one e-mail a day from You Tube with all video response requests. I hadn't yet gotten today's e-mail. Your video response is approved, as are the two others I got already today.
Just DO NOT buy music from this artist or his music publishers--Universal. In the long run, boycotting hurts them much more than piracy: it hurts them in the pocket AND also they become irrelevant to and forgotten by history.
Hit where it's relevant and where it really hurts, it's all these egocentric bastards understand.
@coolnaenaes I have a hard time approving video responses. If I watch the video first, my option to approve it disappears. So any time anyone sends me a video response and it's not some kind of spam, I approve it. If I don't approve your video response, contact me again.
Universal were wrong and I agree that the video should have been allowed up. However, I do worry about the volume and intensity of the music for such a little cute boy.
@senorita67 As you can hear in the video, the wheels of their toys going past are louder than the music. As many others have said, it's a result of poor sound quality as recorded by the digital camera.
Actually it was Prince who was crying and screaming everytime he heard his music on youtube...sad thing is people get so greedy they 4get why they create it. Now maybe a new generation will get hip to his work...as a musican, prince is genius. As a person he is a complete asshole! everyone knows that!!!!
Prince is the creator of this music and therefore he should have a say on how his music is to be heard or released.....
As everyone knows he is like everybody else, a person with good sides and bad sides...In this matter, he is very strict with the copyright issue....but on the other side he gave away many times music for free!
What the label fails to understand is that all this video can do is drive interest in the song (What is it? i cant hear it clearly but I kinda like it, maybe I'll go and search for the real thing) while providing us with a smile at the same time. I feel sad for them...
@mystonicrecords - You can thank the GREED of Universal Music! I am SO glad Prince refused to make anymore music with them! It's no wonder he despised them! BOYCOTT UNIVERSAL MUSIC!
@achampag - I don't believe it was Prince that filed the perjurious DMCA complaint... pretty-sure it was Universal Music Publishing Group (UMPG).
I hope the judge gives edenza treble damages of what EFF cites as their costs, and that edenza can then donate half of it to them (typically, attorneys charge one third for a contingency fee).
What the fuck is this shit.

1luv4aaliyah 1 year ago
@edenza I did not realize that. I had not even heard about all of this until yesterday when I read that Prince said that the internet is basically done. Well, good luck with everything--cute kids. My 8 year old daughter and 3 year old son watched the video over and over again and loved it.
marvchomer 1 year ago 6
@marvchomer Thanks. My kids (now 6-almost-7 and 4 1/2) like to watch it when I pull it up(usually to view a comment or video response) except that Holden says he doesn't like "that noise."
edenza 1 year ago
@marvchomer yeah, Prince says the internet is 'basically done'.. but keep in mind that the man is mentally ill. To call him a rich eccentric is being mild, he does not comprehend things like you or I do - a lot of creative geniuses are not entirely normal upstairs.

the music is outdated, and prince is effing ugly.
that is all

@ashrocks87 music outdated?? how about no. prince has a lot of classics that will NEVER be outdated. try "Purple Rain"

Cute video--let me get this straight--Prince tried to sue to take this video off? What a scum bag. He should be happy people are still listening to his music and the new generation is dancing to it.
marvchomer 1 year ago 10
@marvchomer What happened, in a nutshell, is that I received a takedown notice from YouTube stating that someone had flagged my video as being infringing under the DMCA. I filed a counternotice saying that my video was not infringing. Six weeks later YouTube reinstated my video and I sued UMG for filing the false takedown notice. I'm the plaintiff in the lawsuit, which is a mistake many people make ;)
edenza 1 year ago 11

@marvchomer Not Prince, the record company.

@marvchomer
I guess he is just doing that to make extra money. he doesn't care about people dancing to it, just as long as he gets a few extra bucks each time people use his music.
bcguy216 9 months ago
lets get stupid lets bring more attention to the video wow 30 hits before prince wanted it taken down now over 1,00,000 way to go ... you can hardly hear the music anyway
boob24 1 year ago
So, logically, if we listen to any of this douche bag's music, and any other family members are nearby, we could be sued.

@jamesmanortiz
Even if it's good music, boycott it on principle!

Universal were wrong and I agree that the video should have been allowed up. However, I do worry about the volume and intensity of the music for such a little cute boy.
senorita67 1 year ago
@senorita67 As you can hear in the video, the wheels of their toys going past are louder than the music. As many others have said, it's a result of poor sound quality as recorded by the digital camera.
edenza 1 year ago
Actually it was Prince who was crying and screaming everytime he heard his music on youtube...sad thing is people get so greedy they 4get why they create it. Now maybe a new generation will get hip to his work...as a musican, prince is genius. As a person he is a complete asshole! everyone knows that!!!!
cartell100 1 year ago
@cartell100
Prince is the creator of this music and therefore he should have a say on how his music is to be heard or released.....
As everyone knows he is like everybody else, a person with good sides and bad sides...In this matter, he is very strict with the copyright issue....but on the other side he gave away many times music for free!
solar2005 1 year ago
What the label fails to understand is that all this video can do is drive interest in the song (What is it? i cant hear it clearly but I kinda like it, maybe I'll go and search for the real thing) while providing us with a smile at the same time. I feel sad for them...
seePyou 1 year ago
And you guys still wonder why so many think you can get sued or prosecuted in the US for just about anything?
coppurt 1 year ago
You all realize that Universal just gave Youtube a takedown notice - the lawsuit was the result of the video poster, not Universal.
