first off if you were to actually read the comments made by notch he said himself that he loves Bethesda, and the elder scroll series. Secondly you would have realized that most of the sue was just automated and i highly doubt that they ever thought about getting money from the wonderful indie game maker notch.

Second: If it would be only automated they had dropped the sue or accepted the battle on Quake 3.

I'm sorry if you watched the trailer for their newest unreleased game "The Elder Scrolls: Skyrim" there are a ton of new ideas for a game. If you don't like it make your own game. And the reason why I hate Bethesda is that they make BORRING questgames a 5 year old girl could solve, which are only for 12 + or 16+, because there is much blood. And even with they´r million income they are not able to make it with multiplayer mode
