  • if you listen to this guy and don't take either tests, you'll be arrested anyway for DUI and the officer will write a lengthy report supporting his arrest. If you have an officer with years of experience with DUI drivers who don't submit to testing and has a good repore the courts, then your fucked either way. Here's some advise not mentioned.   • About the section about the right to refuse the roadside breath analysis....In Vermont, we have an "implied consent" law. Upon getting a license, you're agreeing to say yes when asked to take a field sobriety test. If you refuse you could lose your license for half a year.

  • Now if you are not drunk you have nothing to hide from their portable brethalizer, and if they do arrest you even after it proves you aren't drunk, they'll still make you redo it at the station, which will clear you if it matches the portable one.

  • And if they arrest you under suspicion of drunk driving, they can still make you take the brethalizer back at the station, which will at that point prove you are drunk, if indeed you are drunk. No escaping from a DUI.

  • By refusing the portable brethalizer test you keep from giving them info that would justify their arrest he says. I LOLed at that point because the only thing it gives is a number that says the ammount of alcohol in your system. If that number is incriminating it means YOU ARE LEGALLY DRUNK, and YOU HAVE COMMITTED DUI! It's not like something that they can mistake for anything to justify an arrest. Either you are drunk, or you aren't drunk.

  • it is not unlawful to drink alcohol & drive. Nor is it illegal for a pilot to drink alcohol and fly. It is against the law to operate under the INFLUENCE of alcohol. The government, either town, county, or State, tacitly endorses moderate drinking and driving. How? It requires restaurants and bars to obtain liquor licenses AND they must have parking areas sufficient for the patrons expected at those establishments

  • Drinking and driving is NOT illegal...only irresponsible. It is only illegal for "Drivers/Operators" of "Motor Vehicles". A Motor Vehicle is defined under : U.S.C. Title 18 Part 1 Chapter 2 section 31. Only if you are engaged in commerce, then drinking and driving becomes illegal. But of course the Lawer (Liar) won't tell you that.

  • If I go out and have a half a glass of wine with my dinner then decided to shoot pool for an hour then leave why is that considered the same to people as drinking and driving. In the CDL world, an officer can strip-search your truck down to the last bolt and leave it to you to put it back together.   • if you refuse to blow into a breathalizer, the police can get a search warrant to draw your blood...in most cases, refuse all preliminary tests, take the breathalizer, dont answer any questions, be polite and fight it in court. if the officer cant establish that your impaired to the slightest degree, they cant charge you with a DUI. having alcohol in your system doesnt justify a DUI. i've seen guys walk out of jail above the state's BrAC legal limits without being charged for a DUI.

  • Here in IN when they arrest a DUI suspect b4 they take them to jail they take them 2 the nearest hospital which I happen to work at. The suspect is brought in to get something called "medical clearance" b4 they are hauled off 2 jail. At the hospital they are asked to submit to not only a breath test but a blood alcohol test as well.

  • Alcoholics are not usually the ones causing horrific accidents...it is usually the inexperienced drinker that hasn't learned their limit or how alcohol effects them after they have stopped drinking and drive home. they feel OK when they leave...not realizing they will experience more effects from their alcohol consumption beyond that point in time...even though they have stopped drinking.

This man did not mention anything about blood alcohol levels or "drunk people". And he makes money because he knows exactly what he's talking about as a defense attorney.

Will most cops write you a ticket for this? probably not.....but you just broke the law. The only problem is this: The officer training in DUI detection can and will take you under arrest for refusing to take 'pre-breath screenings' when other manifestations of alcohol intoxication are present.   • One time I was pulled over for drunk driving and I really was drunk. I had sped up really fast behind a copped and slowed LOL.

    The cop asked me had I been drinking and I said no. He said that he smells the aroma and I said nothing. I was fumbling my registration and when he asked me to take the test I said no. When he asked if I had any drinks at all I said no. Overall I was courteous and denied/did not give any extra info toward everything that the cop asked me. I got off with no problems.

Ultimately your attorney will get your case thrown out and with an appeal of the suspension they usually give your license back. Best advice is to keep your mouth shut and refuse all tests.     I took one sip and blew a .06 - a beer or 2 can easily register .08 and not feel any affects of alcohol

The incompetent one wanted him to plead guilty. So he could attempt a deal. The one I recommended was very good, and for a little more money he got excellent representation.

  • Yes. You will most likley be arrested at that point. You then have an important decision to make. You can take the breath test at the station or refuse it. If you refuse it your case is most likley going to be dismissed if u get a lawyer, but u face an automatic suspension. If you think you will pass, take it, if not the dont.

    None of you spouting throw people in jail, have invented nor manufactured a breathalyzer machine and know how accurate it is. The science behind a breathalyzer machine is hokey at best. It doesn't even detect ethanol. You could have diabetes and it would read that you are well over the limit.

  • You must live in a fantasy land. Its called a preliminary breath test. A positive reading would then require further investigation. I have never ever ever heard of a false breatherliser reading resulting in a conviction. You need to understand that the effects of drink driving far outweigh your deluded view of peoples rights. Perhaps some evidence of the diabetes rubbish would help too.

  • Here, if you refuse either test, you are treated the same as if you had failed it.

    The best way is to say that you consumed a drink within the last half hour, which would void the results. That gives you sobering up time. use this time to smoke as many cigarettes as possible, this might not disguise your breath, but it will calm you down.

  • In some states if you refuse a breath test out on the road. Your lost. Your license is revoked for one year. The police only needs a reason to stop you and that they suspect you have been drinking alcohol. they read you the implied consent. And if you refuse. You lose ! I see police driving down the road talking on their cell-phones. Where does it stop. Lets take radios out of vehicle so we don't get caught up singing and not paying attention to our driving.

  • get a lawyer and take it to the supreme court and do everyone in the state a favor. that is unconstitutional hands down.

    but people are too afraid of the law to even challenge it. I guarantee someone would say "if you're innocent, why refuse"  [ I always shake my head at that one ]

  • One day someone you know will be killed by a drunken driver and your attitude will change. Its a shame that in our society, a death is what it takes to wake people up. I never complain about random drug or alcohol testing because those that get caught are put off the road. A vigilentg police force is a responsible one and great for the communities welfare.

    you think the police are here to "protect us"? Dude the DUI business is a multi billion dollar cash cow. Pull your head out of the sand and wake up. Go look overseas at their laws. America is one of the lowest DUI countries, but we have the highest rate of incarceration. Private prison industry is booming, in no small part to DUI.
