Strange, I didn't recall that the Constitution exempted foreign "enemies" (you didn't define what enemies were, so I'll assume it's a citizen of a foreign state) from the right of Habeas Corpus.

Assuming it did, this doesn't apply to members of states of any nation except... well, none, since all nations are either neutral or allied.

The sad thing about this is that you don't understand that Scalia is actually an asset in these cases. You may not like his decision here, but he was one of only two justices with the balls to point out that U.S. citizens should have all their due process rights in Hamdi. Every one of your precious liberal justices (except Stevens) sold you out.

The Court's decision will never have the impacts that Scalia claims. Freedom and security can be reconciled within the framework of the rule of law and constitution. We have many bad people in jail, all of whom had lawyers and access to writs of habeas corpus. Scalia and others are just "cut and running" on basic civil rights!

Why is it "right wing" to deny rights ... and what does RvW have to do with anything? By rights, RvW _should_ be overturned by the supreme court as it is unconstitutional in its nature. Not one branch was ever granted the ability to make, pass, or empower such a law under the constitution ... only the _states_ and the people have that power. The only way for to make RvW truly legal is by a constitutional amendment ... or by allowing states to make and enforce their own laws on the subject.

The Supreme Court is sometimes considered the most powerful branch of government. Ever since the case Marbury v Madison and when the court gained the power of judicial review, they've become nearly a dominant branch of government (also the media doesn't recognize that often)

I disagree that they are the most powerful branch. Remember the court cannot enforce its rulings and there have been instances where congress and the president do not listen. Remember andrew jackson's famous refusal to enforce a court ruling or FDR's refusal to listen to the court ruling against putting the Japanese in camps? Usually they are enforced because there is political hell to pay when you don't and can be accused of hurting the constitution.
