  • What kind of idiot is this guy? You have limited obligations as the driver.. You are obligated to provide a drivers license, and depending on local laws proof of insurance and registration. Beyond that you have no obligations. As a passenger you have no obligations to provide id. The officer must have a reasonable articulable suspicion that you have have/are/will commit a crime to trigger the requirement for identification..

  • BIGGEST PROBLEM OUTSIDE OF CAR - A lot of times I go running at night, cops often stop me and obviously lie saying something like "we got a few calls of someone stealing from cars, kinda described what your wearing" ... I know they are lying to get my info... In what legal way can I tell them to fuck off?

  • @itsjustadamnedname ...There are no FEDERAL laws requiring you to identify yourself, but laws in some states require you to, particularly when being identified for suspicious activity. Like, say, when you're being pulled over? You also don't have the right to a lawyer or jury for misdemeanors or minor offenses, such as the majority of traffic violations. You're pulled over, they write you a ticket and send you on your way, NO BIG DEAL. Stop violating laws and you wouldn't have to deal with them.

If the officer has to read from the ticket to testify, he or she is not providing information based on their recollection as a witness.   • @itsjustadamnedname You can challenge any ticket you receive but that's before a judge; you only have the right to a trial before a jury for a prosecution that would warrant 6+ months of prison time. Not traffic violations, like in the video. Also, the 5th amendment protects against self incrimination and double jeopardy. Maybe you meant the 4th amendment, against unreasonable search and seizure? Note the term unreasonable. You do something wrong, you get pulled over, that's reason enough.

  • @itsjustadamnedname most states do in fact have a legal requirement to identify yourself when requested by an officer, plenty of courts have indicated that identifying yourself is not testimony against yourself (unless you're a fugitive from justice). Thus, no 5th amendment right involved. Otherwise, you don't have to talk or answer questions beyond providing the driver license, registration and insurance.

  • NO TASERS for law enforcement. Only officers with advanced training and experience should be allowed to carry firearms. This will force law enforcement to develope their communication skills and their interactions with the public. It will stop them from working from an ego and power hungry position. They will have to work on a much different level if they do not have tasers and immediate access to firearms. They would be less bullying and it would also help their public image.

  • @YoureAlwaysRight I concur, but that opens a can of worms. Being able to defend your self/family and your property entitles you to possess modern or commonly confronted/conventional weaponry...so should cops. However much I dislike it.

    But, if you understand the purpose of a police officer, they are peace officers in their primary capacity, and law enforcement secondarily. As long as you state your peace and immediately open dialogue in a peaceful Sovereign capacity, they stay peace officers.

  • @YoureAlwaysRight I know this because I have had lengthy conversations with peace officers (sheriffs, city police, and my uncle who is a Washington state trooper)...they prefer to be peace officers and not have to resort to threat of force (which, if anyone understands, creates a problem in judicial process...unless you have already committed a crime or are in the process of committing a crime, they have no authority to threaten or use force. Period.)

There are peace officers that have been in law enforcement for years and agree that guys are too quick to use the taser.These officers talk about command presence,community based policing and people skills to deal with lower level problems.

    Many police officers (not a huge portion, but enough) should not be police officers; simple as that. It's not a history of abuse, it's the propensity for abuse.

  • Instead of resorting to weapons when it is almost too late, instead of giving everyone the benefit of the doubt, these specific officers immediately wield their tools of force when confronted with a complicated situation. Maybe 5% of all people who have to deal with a police officer actually do anything to justify the use of these weapons; many of them do not.

    I read a story awhile back of a police officer tasing a 10 year old girl because she was "unruly and wild".

  • The gist was that the parents could not get her to go to bed at bedtime, and they called the police not knowing what to do. Officer showed up, girl thrashed, officer tazed. That is not a lawful use, and just one potential example.

Now, I am not a strong believer in IQ testing, considering there can be and are exceptions to the rule...but when the average test concludes that police officers are not very bright, it points to a failing of legislation. Lower IQs leave little room for creative thinking; they blindly follow their codes and procedures without regard to the CONSTITUTION.

  • If I dressed up as a cop went on highway roads in a ford crown vic, and wore a uniform complete with the usual gear, I could turn on my lights and pull everybody over I chose. I could ask for ID and SSN's and threaten people's rights and property if they didn't submit to my agenda. How would the people distinguish the fraud cop, and shouldn't the people be able to ask the charge or reason they've been detained, shouldn't the cop prove he is lawfully able to conduct law.

  • @zeppelinman07 Police officers are mandated to provide their business card and badge number upon demand by a member of the public. A fraudulent cop would not have them or, upon calling his bluff, would abandon the scene.

    Even so, a proper police officer would act in his peace officer capacity if his/her initial impression of you if that of a peaceful sovereign exercising rights with full respect to public peace.

  • Is this guy a professor of tax law? I'm amazed at the amount of bad advice out there by law "professionals." Lawyers will rarely give you sound advice because they want you to become dependent on them--the same way that doctors don't want easy cures for diseases. Other than giving your basic driving information, you do not have to answer any questions, possibly incriminating yourself, ie., "being cooperative." It's called "5th Ammendment Rights." Maybe this professor should Google it? Geez!!

    If you are pulled over, you are required to show license, registration, and proof of insurance. Other than that, you have all other rights including the one you should always use: the right to remain silent.

    You do NOT have to cooperate with the police, and no good lawyer would recommend that you do.

  • You have a lot more to lose than to gain EVERY time you are pulled over, never admit guilt or answer to many questions. Instead ASK THEM questions. Ask them if you are a criminal, ask them if you are being detained, ask them to cite the statutes and laws they are going to use to justify getting your ID if they cannot answer as a PEACE KEEPING OFFICER, then you are innocent until proven guilty. This is horrible advice and I suggest doing a lot more research on the topic. My two cents ;)

If they say yes then ask them what crime you have committed and under which statutes OR law, very important to distinguish. If they fail to provide you with all of this information, their legal capacity goes down the tubes. Don't be rude, be cheerful and kind! :)

  • @Poonard When you are pulled over, this means that the officer has probable cause to believe you have commit, or are about to commit a crime, or there is objective evidence leading to the traffic stop. Not providing ID would be non-compliance. If you have nothing to hide, why would you not comply?

  • @Poonard In IL, you do. You are required to have your DL on your person while driving. If you don't, it's cause for issuance of a traffic ticket.

  • @ilangsfs: On the other hand, officers need at least a reasonable and articulable suspicion of criminal activity before they stop you (except at an international border or a constitutional checkpoint). If they do not, it is an unconstitutional stop, and you do NOT have to identify yourself.

  • @Poonard The biggest LOL is that police officers (LEO's, not Peace Officers) only have authority over you in a vehicle if you are committing or have committed (or are suspected of committing) a crime. Traffic violations are CIVIL violations, and I've beaten tickets with a variety of methods..the best so far is that police officers in uniform are NOT members of the public and have no cause or authority (by me, since I'm a member of The People) to bring suit in their name. ;)

We need to be extra careful deviating from it - especially when we call the cops on their civil rights violations. They REALLY hate that.   • @rotnflesh plain and simple...don't give a cop any reason to fuck you up and you'll be good, that includes telling him ANYTHING about you, or giving him your license...or admitting guilt...lol it is pretty damn easy to get out of tickets.

    The government doesn't give you rights they only try to regulate them try and trick you into believing they can take them away as if they were a privilege.

  • I've been pulled over for speeding 7 times.I have never got a ticket,heres how:

    Shut the engine off.

    Throw keys on dash.

    Hands remain visible at all times.

    Turn on dome light.

    Dont reach into glove compartment untill they ask you to.

    Be polite.

    My neighbor is chief of police and my best friends brother is on SWAT team.They both gave me thoes tips and they work.

  • yes, i would'nt advise women or teens for that matter, to stop for a cop on say a deserted highway.. you should probably call your husband, son, dad, brother, whatever, and tell them where you are and what happend, call the police and tell em, and try to motion to the cop to follow you into town or something, preferably a police station... obeying a damned cop isnt worth losing your life over, besides, its very dangerous to stop on a highway, even if off to the side, a truck may smash into you

    IOgherwise, I'd say, put your window down only an inch, and thell the officer to take you to the nearest police station, and you will be very willing to submit to a the questioning.

    yeah also calling 911 and requesting a female officer is good. they get pissed if you do the inch thing but hell with them. you pay there salaries and its legal to crack it a inch to slide identification. they wanna pursue more, do the number you said, or 911 and ask for female officers. informing the cop your calling 911 will help too, most will accept and go with it, though there are rambos out there. bone heads. making up for what they lack i guess.

    That 's the law, but it is very dangerous to do all this at night. Esp, for women. There are criminals working at night, especially in deserted areas- both in and out of uniform. To be stopped at night, and then have your car illuminated, and your window down..is often asking for trouble for your physical safety.

  • If your driving a car and you are pulled over you are required to show license, registration and proof of insurance. How ever if your walking down the street and a cop stops you, you do not have to identify yourself and the officer has to tell you why he stopped you. If he's asking questions like where your going or what youll be doing later on, unless its pertinent to an active investigation you dont have to tell him anything. BE RESPECTFUL! otherwhise youll get arrested for disorderly conduct.
