  • It depends on where you live some cities classify bows as weapons and its illegal to discharge a weapon within city limits. Other areas have laws against using bows within a certain number of feet of residential dwellings. From what I can see in the video it's not like they have 5 acres of land. The houses look like they are right on top of each other, so he was probably in the wrong, but I could be wrong.

Reasonable suspicion means a warrant (with an A, oh person who very clearly has studied so much of the law) is not necessary to go on the porch and arrest him.. ;)

  • You don't have to show an ID in this case. Period. Unless you are carrying a gun (legally), in a liquor store, or driving a vehicle, you do not need to have an ID. Plus, unless the cop was a first hand witness to a crime, he cannot search a home without owners consent or a warrant. Once again, the cops violating civil rights. It's only gonna get worse folks.

  • Well technically and morally if an arrest is a false one, any action by an officer is a form of assault and attempted kidnapping. If they complete the wrongful arrest they are kidnapping a citizen. Technically resisting a wrongful arrest is within your right as a human being and a defense against an assault. However it will never work unless there is a crowd of people with you to help you. However resisting such is much harder than cooperating.

Why did your husband assault a police officer if he did not do anything wrong? Why was your husband shooting a crossbow in a residential area? They need ID to run your name through the system to see if you have any warrants for your arrest. Simple as that.

Even if the police officer is making an unconstitutional demand the person still has to follow the order. They can sue for the violation of their rights later but at the moment they have to do what they are told. Also, even if they could resist unconstitutional behavior, the police were acting perfectly lawful in this video. The lady is just being a ridiculous douche.

According to the video they asked for consent to enter her house, she refused it and they sought a warrant to enter. They did everything professionally and in accordance with the law.   • @josacape right, in that case they did not make any decision regarding whether or not it is illegal to resist excessive force. They just said that you cant resist an arrest. No matter if it is a legal or an illegal arrest. Also, I dont really see how this has become an issue of contention since there were no illegal arrests or excessive force exhibited in this video.

  • @Pafoofnik1 Sry, it wasnt a link. Its just the name of the case. It's an Indiana case because I was responding to josacape's citing of Plummer v. State; which is also an Indiana case. The case law is pretty much the same throughout all courts. Just check your local municipal ordinances and it will almost certainly say something to the effect of an unlawful arrest not being an affirmative defense for resisting.

Apparently for no reason other than that the mother had the audacity to video tape and ask the police why her husband was being taken away. I find it SICKENING that a police officer would attempt to throw his weight around like that and it shows complete disregard for the welfare of that child. Whether I was right or not, under no circumstances would I ever want my children to see that kind of conduct from me, my wife, or from the police as a result of my behavior. People who think they are so well versed in law often cause themselves more problems. This setting is not a courtroom, and because he "thought" he knew laws better than the police, a simple warning turned into a felony.     I thought that may have been the issue. He may very well have been shooting it safely, but I don't know, so I really can't argue the safety issue either way. He should've just identified himself, he probalby would've got a warning anyways, but if he was cited, articulate the safety issue in court I guess. But without seeing if there were other trailers behind the target, or areas for people to walk behind the target, it's hard to say. Brings up an interesting argument however.

Like most videos alleging police misconduct, it sure would be nice to have a video of the events that led up to your husband getting arrested. You keep repeating that your husband "did nothing," but yet you weren't even out there to see what caused the massive police response. It sounds like to me that he committed a violation.....

  • @Pafoofnik1 its not a firearm, a fire arm is a hand gun or rifle anything that uses a propellant like gunpowder. A cross bow is not a firearm it is not the same thing. it should not be illegal to target practice with a cross bow in city limits, as long as you are safe with it and make sure no one or animal is in the line of fire then i have no problem with it.
