If NHTSA is doing this test now, IIHS should do this test as well for every car 2011 and up. Even though they do the roof test and side crashes to simulate the stength of the safety cage , it may or may not make a difference with the side pole test.
Well actually, BMW kinda had it all down. If a short person would be driving, there's a likely chance that the person would scoot the seat forward, thus bringing it to the level of the airbag. If a much taller person would be sitting, he would be sitting farther, towards the upper part of the airbag. BMW had it all sorted out. But it is still possible for the person to miss the airbag. But that was a while back, they use curtain airbags now.

you have production year wrong. production started at 1996, facelift 2000 and production ended 2003.

Well, not the frontal. And to be honest, it's insane, but the new 5-Series actually got a modest 3 stars from NHTSA in the frontal... Strange.
