But, if people don't know the law, they are surely not going to explain it to them. CVSA (Commercial Vehicle Safety Act) does not require a LEO to have a PC before stopping a commercial vehicle. Also bear in mind that the law of the state that you are in applies not the law of the state the vehicle is registered in.

If police are preparing to pull over a vehicle and it crosses a state line they don't have to stop pulling it over, especially if it has a warent out for it. Comercial inspections don't involve towing unless there is a serious problem. It caught some attention and someone noticed a law had already been broken? Can't take evidence away smells like warent and inspection sounds like why.

(Therefore the police had it towed)

Also you don't need to have a licence or registration to transport a vehicle, since you're NOT using it for commerce. You're not driving people for money. However, if you're using the bus to transport goods to sell (commerce), then you do need a licence and registration.

But, if people don't know the law, they are surely not going to explain it to them. She could have refused them entry and they would have had to get a search warrant from a Judge to legally search it, and even then- the Judge will not issue said warrant without probable cause. But, this was before the ILLEGAL Patriot Act.

Police do NOT have the right to pull over, harass, detain, arrest or otherwise molest someone without probable cause. The good thing is that they'll probably get their bus back, the bad thing is that it'll cost more in legal fees than what the bus is worth. There seems to be an issue of free speech here too. Those police should be censured (I'm not an environmentalist).
Ok to enforce the laws, but this is not the letter or spirit of the law.

The tow trucks are usually in cohort with the cops, and charge whatever they feel like. I once had to pay $200 bucks to get my toyota Echo back after being towed two blocks and stored for 4 hours. CVSA (Commercial Vehicle Safety Act) does not require a LEO to have a PC before stopping a commercial vehicle. Also bear in mind that the law of the state that you are in applies not the law of the state the vehicle is registered in.

A school bus tagged in Montana requires a CDL, making it a comercial vehicle. If police are preparing to pull over a vehicle and it crosses a state line they don't have to stop pulling it over, especially if it has a warent out for it. Comercial inspections don't involve towing unless there is a serious problem. It caught some attention and someone noticed a law had already been broken? Can't take evidence away smells like warent and inspection sounds like why.

You need to file a Federal Civil Rights lawsuit under Title 42 Section 1983 of the Federal Code. You can find info on how to do it on your own at the Ninth Circuit's website, (that's in San Francisco but it's all Federal courts, only the local rules may be different. Actually, on a federal level, any vehicle that has been converted to a motor home requires only a class C license to operate.

My company was the one who towed the bus away.People from other states need to realize that ignorance to other states laws is not an excuse.We tow cars from people from Wisconsin all the time because of no insurance.When you come over the border to Minnesota you need to place an insurance binder on your car.

Alright I opened my mouth a little to early. Technically this vehicle could be considered a commercial vehicle based on weight and size alone. I just don't believe someone should be required to hold a commercial license if the vehicle they are using isn't being used for commercial purposes. Sorry about that ADFSVB

Others have already mentioned license class. Permibus blog says bus is used to transport people & materials for a "family education project" teaching "homesteading, citizenship, and life skills," a "donation supported project." One person also engages in "work as a street medic," also accepting donations. Since money is exchanged, facilitated & advertised by that bus, it's a commercial vehicle.

That bus is a Class B commercial vehicle (look it up) and from her reaction, she did not hold a Commercial Class B licence, drivers of any commercial vehicle are required to hold a commercial licence and run a log, regardless of how it was registered in Montana, That alone would have the bus impounded and a DOT inspection would be done, none of them having a licence to drive it would mean none of them could drive it away. (Therefore the police had it towed)

Wouldn't the bus only be a COMMERCIAL vehicle if it is used for a COMMERCIAL purpose? Ya know, dealing with money? Vehicles such as semi trucks hauling goods for stores, city busses, those are commercial vehicles. Prove to me that this bus that was impounded is a commercial vehicle. Just being a bus doesn't make it Commercial.

Under Department Of Transportation Guidelines, this is a Class B vehicle requiring a Class B Licence, look at yours, if you live in America and you drive a normal car yours likely says Class R. The definetions of Class R say you cannot drive a vehicle that weighs over a specified limit, this bus does. The term Commercial refers to the typical use of the vehicle, NOT the reasons it is used, It stinks that these people were stranded, but the law is the law. We all follow it.
