While the motivations of these GOP attorney's general are about as deep as applesauce on a plate, I'd love it if they struck down the Nebraska payoff as being unconstitutional. That would have the effect of getting rid of it while forcing Nelson into the position of either having to vote for the final bill without it, or looking like the only reason he supported it was because of the payoff.

If you ask me, earmarks should be all but banned. It's FEDERAL tax dollars, for christ sake. It's supposed to help ALL AMERICANS. The states and localities can raise money for their projects on their own, not by asking Congressmen to insert them into bills at the last minute.

I agree with you whole heartedly, but let's not make earmarks the specific enemy because they're only one of many examples of corruption, pork and payola that need to be eliminated. An "earmark" is a spending provision that's inserted into a bill AFTER it's been written, and only requires two Representatives or Senators to put it in.

So technically this isn't an earmark, it's a "sweetener" which was inserted WHILE the bill was being written, specifically to buy one Senator's vote.
