One night in winter I went for a couple of beers after work. Walking home it was freezing and I was bent over against the wind when I heard someone yell: "Hey buddy come over here." Looking around I saw a cop car, went over, hunkered down to window level and asked: "What's up?" The answer was they were pulling over young black guys with hoods up carrying back packs. I told the clerk that the officer only issued a DUI ticket that night, not a speeding. She looked at her computer & said, 'Oh, he mailed it to u.' Ultimately, I got the speeding case reopened. The cop didn't show day of trial. I was pissed b/c I wanted to confront him at trail.
only thing you are required to answer is your identification to a police officer. Other than that, there's absolutely nothing that you need to answer, it is your constitutional right. And in this particular case, the idiot cop was simply hell bent on arresting the driver. He was obviously frustrated after the guy passed the walking the line test. One night in winter I went for a couple of beers after work. Walking home it was freezing and I was bent over against the wind when I heard someone yell: "Hey buddy come over here." Looking around I saw a cop car, went over, hunkered down to window level and asked: "What's up?" The answer was they were pulling over young black guys with hoods up carrying back packs. The reason he's asking him to stand with his foot cross already is once he starts walking he is already off balance. Even a sober person will start to lose there balance it's trick. Also this ticket would be easy to beat because at the time of the incident the officers never took a breath test nor did the officer indicate that you are failing this test or that one. Because how does anyone know based on this video wheather or not his eyes are jumping in the corners. So fact entered into evid.

Secondly, why the hell wouldn't you answer "Where are you going?" or "Where are you coming from?". Those are both pertinent, and non threatening questions.

@AuburnJunky 1st, I didn't answer the questions b/c that's not y he stopped me. He didn't evn cite me for speeding. Where he 1st saw me, the hi-way is configured such that it was impossible for him to hv seen me, let alone determined my speed.
2nd, If pulled over for speeding what relevance is where I'm going or coming from? It is illegal n America for cops to stop ppl to see "where they r going" or "where they r coming from".

It says you were arrested for DUI. Did they perform a field sobriety test? Did you do a breathalyzer? If not, then it seems like he was trying to hit you with a more expensive charger because you were being belligerent. Usually police ask you questions to discern probable cause.

@concerneduscitizen22 DUI was thrown out. Discovered n Nov. tht my license was suspended. Went to crt to find out y. Learned it was for an unpaid speeding ticket that this officer wrote. I told the clerk that the officer only issued a DUI ticket that night, not a speeding. She looked at her computer & said, 'Oh, he mailed it to u.' Ultimately, I got the speeding case reopened. The cop didn't show day of trial. I was pissed b/c I wanted to confront him at trail.

only thing you are required to answer is your identification to a police officer. Other than that, there's absolutely nothing that you need to answer, it is your constitutional right. And in this particular case, the idiot cop was simply hell bent on arresting the driver. He was obviously frustrated after the guy passed the walking the line test. I really commend the way the driver of that vehicle handled the situation in such a calm and composed manner.

I don't care what color you are, you are going to get booked if you cross an officer like this. The guy should have seen that the officer was a dick, and then just complied to get home with as little hassle and monetary damage as possible. NOW this guy is out lawyer's fees, and time, because he chose to bait the cop.

THE DRIVER DID EVERYTHING RIGHT. When police ask you questions like, where are you going / coming from, they are REQUESTING you to answer them...not ordering you to. They also cannot order you to answer questions unless they have probable cause...which you are likely to mistakenly give them by answering their strategic and often self incriminating questions.
Know your rights>>it's imperative! No pun intended ahah oh and ya, this guy was clearly not intoxicated.

The officer was obviously a total ass, the pat down was totally illegal not meeting the requirements of Terry v Ohio.
The driver should not have taken the roadside tests.....those are totally optional.
I'm sure this case was dismissed.

@2204Alpha cops are suppose to do searches when you make and arrest. its called a search of apprehension. you are able to search the person and anything within his grasp from initial contact. the cop could have actually searched the front seat of his car technically. thought they dont usually. he did fail the fst. the cop fucked up because he didnt ask for the guys consent to the fst. your right you dont have to do the fst and in some cases its better not to do so

You should've filed a lawsuit because it's clear that it bothered him when you wouldn't tell him where you were coming from and in some states you have the right not to answer personal questions like that one. I would talk to a lawyer because it cost you, humiliation, time, and probably money to get your car out of the inpound. You can get a free consultation if you look around carefully but quickly.
