  • spotlight-figuring out if you guys had any weapons or were a threat, and since you're pointing a camera at them, which is completely legal in most situations i agree, they're pointing a spotlight at you, again which is completely legal. the 3 girls they were "questioning" the one was clearly drunk and your bitchy voice pops in saying just keep walking, if they wanted to be dicks they could have arrested her for public intoxication.

How would you feel if you were trying to do your job and someone comes up, films you, then when you ask them to leave you alone all they say is "I have a right to observe the public." This is pointless and just shows how people will to anything to antagonize the ones who protect them.

The cops went out of their way to get close to those with a camera. Sorry joey! The days of blind obedience to being commanded by a cop are gone. The cop must act within the LAW the same as a citizen. Taxpayers are getting tired of seeing their money being paid for lawsuits because of power hungry bully boy cops.

  • Though I do agree with what you do, they did not falsely arrest you. A misdemeanor citation is an arrest, you were charged with a misdemeanor. They do have the right to search you. "search incident to arrest". It is still an arrest.

  • @Bloodhoun34Returns -Your statement was "If a cop asks for ID it's illegal not to produce ID", I never said anything about Obstruction. 1511=Definitions for certain provisions; general provision. 1514=Civil action to restrain harassment of a victim or witness. Telling someone they don't have to talk too police is not obstruction.

I also do not believe everything someone says or shows as the entire story... I maintain an objective view of the scenarios and only make a judgement once I feel there is sufficient evidence. In summary... this is being educated and able to think for myself - You may want to try it sometime. I understand there are education grants for the mentally disabled.

  • As SOON as they say that you are detained immediately initiate your right to remain silent. In my state the ONLY thing that I am required by law to given them is my name and address. I am not required to give them a driver's license (since I was not driving at the time of the infraction) or anything.

  • @napkins714 There is nowhere in the US that you are required to carry an ID card. Some jurisdictions require you to identify yourself when asked, but that merely means stating your name.  You can not be arrested for not having ID.

  • I saw two crimes committed by the copwatchers in this video.

    1) When the lady said "you don't have to talk to them"... she was interfering with an investigation / obstructing justice.

    2) When they said you had to leave... and you refused... you committed the crime of loitering / trespassing (assuming the store owner wanted to prosecute criminally). You can film the police away from the business.

    ...Just saying that there are legal ways to "cop watch" and this isn't it.

If it prevents the officer from conducting an investigation it is by definition "interfering with an investigation". You refusing to leave makes that point even more and may also make you guilty of loitering and trespassing.

Show me in statute where it says that talking to someone while they are talking to an officer is illegal. In most cases, officers are more than happy to let people talk forever - the more a suspect talks, the more information the police can gather. They only get upset when what is said amounts to, "Shut Up!"

    It is impossible to trespass on public property.

  • If you have'nt seen the series of documentaries Police State 2000,Police State 2,3 and 4 then you really need to watch them because they explain what's been happening with police training since 2000.They are being Millitarised and many cops are returning vets from Iraq and Afghanistan,Don't get me wrong I've seen some pretty good American cops but the bad apples spoil it for the rest.It's no wonder many people don't trust them.They should just follow the constitution,they are the good ones.

  • I don't think they are aloud to look through your telephone without a warrant and they have to be specific on that warrant as to what they're looking for.I am not sure about that because I'm not American but from what i've seen and heard i believe I'm correct.I wish people would do a follow up video part2 to let us know what happened next.e.g. court case ,further harrasement,fines you know a general comment by vidiographer.Keep up the good work.

Respect is earned, not taken, and simply putting on a uniform does not earn any respect. Public servants in public places do not have the right to stop individuals from filming them. Maybe they wouldn't be so worried about cameras (you think they aren't briefed about such things?) if their very training and standard operating procedures didn't breach common law.

  • Officer Lemus asked you for ID because they were checking on underage club patrons. The camera crew were loitering meaning if they don't have a business there, leave.

  • @dilober loitering is a misdemeanor, not an arrest able offense. There is a difference, learn it. Low Frequency transmitters and terrorists huh? Wow. Any action regarding the loitering must come with a direct complaint from the property owner, and the burden of proof is on the plaintiff. Officers can ask for id all they want you aren't required to give it to them unless you are under arrest, at which time you must be informed and immediately processed.

  • I have witnessed the tides change rapidly from safe to dangerous downtown. At least one of those three girls was obviously having trouble standing on her own (May we say drunk in public)? Cops are citizens like you and me who have a job enforcing laws. You watch any HUMAN BEING long enough and they will mess up somewhere.

    The problem is not with the cops, it's with the general public and their sorry lack of understanding of their own damn rights and laws.

Cops regularly abuse people's rights, in fact, they are trained to. They intimidate and harass people to get them to waive their rights rather than stand by them. It's absolutely sickening. Google cops advice on dealing with cops, and take a read on what a retired cop tells you. Then take off the blinders and open the eyes.

  • @zchamberlain2012 The fact that the cops allowed the girls to leave implies that they had not committed a crime, otherwise the girls would not have been allowed to leave and the MCW also would have been subject to the crime you referred to. Unfortunately you're ignorant of your rights. You can not be legally arrested without probable cause. In this case, the police would have been guilty of a class A misdemeanor for unlawfully violating their right to film in public, at least in Texas.

  • You can film anywhere in public. It doesn't mention cops specifically. But if you are in public... Did you know you can also film your own court hearing? You just have to go through some hoops but its legal to do so.
