If a business begins to loose profit (either from a down turn economy or higher taxes), they are going to restructure to regain that loss. In fact, the business, if stock owned, has a fudiciary responsibility to the stock holder to do so. If that means cutting jobs, it will. Then who wins? The business pays more money but fewer people are working... yea that works out well dont it.

1) Obama will allow the Bush tax cuts to expire. Currently your standard tax deduction for single person is 5350 and 10700 for married. If allowed to expire your deduction drops to 4300 single and 8600 married. Now, Obama's plan calls for no new taxes if you earn less than 250k a year. However, since you are loosing 1k-2k in your standard deduction.. you will actually pay 1-2k more in taxes.

A five man plumbing business with gross sales of half a million (minus $50,000 in salary for each 4 employees and $100,000 in salary for Joe himself....also subtract cost of supplies, office rent, etc.) would still not qualify for the higher tax bracket under Obama.

in actuality.. the increase is from 36% to 39%. So the difference on 250k is a difference of 90k at 36% and 97500 so the difference is 7500 dollars. That is based on a profit of 250k. However, the capital gains tax is not on profit it is on company gross.... So yes if the company grosses over 250k.... the company will pay the extra 7.5k.

ask yourself... do you report the income you netted on your tax forms.. what you grossed and then take out deductions.  Also, look at your tax form... where is the capital gains question.. before or after deductions? It is listed under INCOME before deductions. So yes, if Joe bought a company whose gross was over 250k. he would be paying the higher taxes. Also note: Obama himself said it was a plan to spread the wealth. Dont come looking at my wallet if you cant earn it on your own.

You are confusing your personal tax returns with the tax forms files by corporations, which are substantially different.

And one would hope that such an astute business man as Mr. Joe Plumber would have the foresight to incorporate his business, which is standard practice for even very small companies.

Capital Gains are not just on corporations. Capital gains are also on personal income tax when you are a business owner and self employed... most small business owners pay themselves from the company as a paycheck... unlike corporations which are seperate entities unto themselves so that even the owner is considered an employee of the corporation not self employed. Please before answering... check into the definitions of self employed and corporation.

Also, I would like to point out the cost involved in incorporating a business. Also, most small business' are LLC (limited liability corporation) which does not create a seperate entity (as corporations are considered by law), but creates a situation where the owner is given a limited amount of protections from lawsuits and other costs of business. The sole owner is still considered SELF Employed under a LLC. Thus the capital gains of the company fall to the owner.

Correct, the increase is from 36% to 39%. But the extra 3% is only taken from the amount that exceeds $250,000. So If you make $260,000 per year after deductions, you are taxed the extra 3% on $10,000 which would be $300.
