  • I definitely think juicystar07 and allthatglitters make videos to get money and exposure to further their fame. i'm not trying to start a big controversy here, but something about them just doesn't seem honest or genuine. i definitely think they feel this is their shot at fame since they don't have any actual talent to make them famous

  • After over 45 minutes on the phone with the FTC, there are SEVERAL things that haven't been clearly spelled out!

    While not an official word, I am told that the older videos and posts that "we have control of" must include a disclaimer in some sort of manner..

    I can tell you, after 45 minutes on the phone, it's not as simple as "it appears"

  • I think this is great, I am glad the FTC is cracking down on this. All the dishonest reviews and product pimping on utube is way out of control. Full disclosure is the way to go. You have a great channel, I am going to subscribe.

  • another thing...i feel that people should take it for what it is, and stop making their own conclusions so they can keep themselves out of trouble and to keep them from losing unecessary monies.....period...point blank......

  • But no one has a right to tell us what to do to that extent. These new rules are just monopolies for the big companies to not have to compete regarding advertisements. THey have to pay millions to be on tv and that is why they are famous because of agresssive marketing...however, on the internet it is basically free and creates equal opportunities for companies who might have a great product but maybe not the marketing power of mac or maybelline. Wake up people.

  • EXACTLY!!!....therefore....you­r pockets will be hit if you violate the guidelines...true she did not actually state they would fine people for not setting disclaimers....but she didn't say they wouldn't.....there has to be something thats legally binding in the process....i feel that this goes for anyone who reviews any type of product in their videos/blogs....if there are rules/guidelines.... there are consequences for not following them....period....everyone should just be smart about it...

  • Well from what I'm hearing this is a good thing ... It's going to protect viewers/ consumers.... a lot of ppl are using their blogs and youtube channel for evil... I guess anyone who complains or is scared about this are the ppl who been deceitful and have no integrity or conscience .... this is only a problem to the ppl who are taking advantage of their viewers by making a profit off of us... simple as that

  • I usually search reviews on the products that I want to buy before i buy them. Sometimes eventhough someone says I don't like, i'll still buy.

  • hi erin! yeah, i watched that video last night also, and it did case a massive panic. it seems fairly simple to me, however; if you are given product gratis to review, be sure to mention that it was given to you specifically for review by "x" company. on the other hand, if you aren't sure if you have to disclose or not, just disclose the information and get on with making/posting your video. seems to me that it wouldn't be that much more than listing

  • I just want to let people know that an agency can levy a fine. An agency is the arm of the government that ensures quick enforcement of their regulations. If they couldn't fine without going through the judicial process agencies like OSHA and the FDA would be moot. Would you really want to wait for a court hearing to have contaminated foods be removed or force an employer to implement safety? NO! This is the same, just consumer protection against disguised infomercials on youtube

  • I like your hair. I really don't think an average blogger will be fined. There is just not enough money to hire enough reviewers to check everyone. However, I am sure it you are checked and found in error. You would get a cease and dis-cease order. If you don't, that is when a fine would be accessed.

  • Actually you are wrong. You will not get fined because the FTC doesn't fine. If it determines the person has violated it's guidelines, it will issue a complaint and notice of hearing where the person can show cause why a cease and desist order should not be entered against them. There is a civil penalty ONLY if you violate the cease and desist order but not for violating the guidelines itself. 15 U.S.C. 45 and 16 CFR Part 255. Now that's what's called citing your authority.

  • Secondly, it doesn't say you "have to say 'I got this free'". You simply have to disclose if you have received anything from the company, money or in-kind exchange (i.e. goodies from the company) to review its product or if you have a relationship of any type with the company.

  • IT is not as simple as being fined, FTC has to follow due process.

  • I agree it does show when people are just in it for the money and free swag! I was sad when you locked your hair since I was on my natural journey but it suits you and I still learn other stuff!

  • the bill is 13 pages long and available on the FTC's website. I suggest everyone read it themselves. It even gives example scenarios to clarify certain situations. But it does state that you have to disclose how you got your products in every video, post, or tweet or you WILL be held liable. They CAN fine you. Read example 5 on page 4-5 as this directly applies to how beauty bloggers review products.

  • Thanks for your comments. Actually, if you read the FTC's statements, a representative states that they do not have the authority to fine individuals, but may be able to penalize the brands themselves. Check out the ftc website and the links on the sidebar for more information.

  • you can not say "sample"you have to specifically say it was free...you need to change that

    believe it or not some people do not know what "sample" means and the FTC will NOT Accept it.

    you dont have to believe me but it has to SPECIFICALLY state it was FREE not "sample" etc.

    but I agree that other video is very misleading

  • My issue is companies that send out mass free product and immediately after, they raise prices on buyers to subsidize the costs of the freebies that reviewers keep and give to families and friends. Sigma Makeup is a prime example and sorry, but I am not paying for select Gurus to have free gifts just because I don't make time to do youtube reviews. I think disclosure is simple, easy and should exist and for those with nothing to hide, should not be an issue. Thanks Erin for this update.

  • I agree with the disclosure. "Free stuff" will make some bloggers post positive reviews about products even though they had a bad experience with it. It makes sense to me now, because one week I'll see a video by a certain blogger claiming that a product is their go to, must have, best brand. Then like 3 days later they post a new vid making the same claims about a diff brand. LOL. Clearly, they were just saying that to get you to buy the company's products. Sneaky. LOL.

I'm not worried too much though because I'll just keep in mind to mention, if I received a sample while using it in a video. I think I'm fine for the most part, but still I'll check to make sure.   • Great information. People need to stop freaking out and READ. We go on hearsay too much these days when we can google and search for the information like you did. I was not worried because I READ 1st.  With all the information out there people still forget how to search and READ. Great links also and love the lip look.   • oh my goodness, you have made this much easier to listen to. You're clear about what your trying to say. So if you get if for free, disclose. If you buy it yourself, no need to disclose. One question?? Can we still say i'm using this mac shadow called fig? and sigma brush 224. Is that okay to say? with out putting a disclouser in the side bar?

  • From my interpretation of the rule, if the only reason you always use MAC or Sigma brushes or any products in your videos is because you were paid by these companies to use them, then YES, you would need to disclose that. But if you use them cuz you bought them and like them... then no.. Hope that makes sense! :D

  • A sentence in the sidebar will be fine! All you need to do is simply write something like "I received "product x* as a sample by the company." That's all! You'll be fine!

  • Awesome video. This is how my lawyer explained it to me after he went through the guidelines. He said that the guidelines are to vague and open to interpretation and given the extremely high risk of being falsely reported that he felt that it was best to disclose everything. He said that whether or not I pay for an item or receive it for free I should still disclose because I would be covering my basis. That way if I was falsely reported, the investigation would stop as quickly as it started.
