  • the way that boy is acting is understandable, but its not acceptable. the way he's talking to his mom is the same way his father talks to her. if she didn't take her son with her, that's just another cycle of abuse just waiting to happen.

  • The reason its kidnap if no custody is established between the parents is because they lived together for the 12 years they are both considered to have custody. So in that case any parent leaving the state, country...or just holding the child from the other parent is considered kidnapping. You have to have a protection order or "cps" have a emergency stop for visitation with the other parent for it to be considered NOT kidnapping if you take off with your child. In most cases thats a sad reality

  • @jerico641 If you leave without the father/mother knowing it's kidnapping. Both parents have to have a say in what goes on with their kid, so if one parents suddenly takes off with their kid and doesn't let the other one know it's kidnapping.

    Not saying she shouldn't have left with her kid. Just letting you know the legal side of it.

    Hmm, I never heard that one before; is that the law in all states, or does it vary? I live in Florida and it seems to me that if a parent and child are missing, you can report them as missing, but not as a kidnapping accusation (so long as there aren't visitation rights or something like that stemming from a divorce). Or at least that's what I thought.

  • @jerico641 I live in California. I'm a criminal justice major so I know that what I said is true for at least this state and on the federal level. But it is possible that Florida has different laws regarding this.

  • @Chamillion8 - Unless there's a custody order in place, and I'm assuming there's none here yet, she's free to take the child wherever she wants, without anyone's permission. ... Totally legal. Also, if/when they do go to court, and she proves he's a danger to the child (mentally - calling his mother a slut in front of him is psychologically damaging, etc.) the order may call for supervised visits. Who knows what he'll say to his son about his mother? "Poisoning of the mind" is considered abuse.

  • In Regards to the "Kiss-My-Butt Thing": Childhood is like bootcamp for kids. In short, they also have ways of expressing their emotions, even if they aren't always in the proper manner. That's when parents' teaching comes into play. We all say inappropriate things at times, even kids. Should she have beat him for saying that? No, of course not! That'd be an oxymoron. He said he was sorry - lesson taught. Bringing kids up with violence perpetuates the cycle ... Just my two cents ...
