Honest to truth, I don't even really see the reason for Square Enix to hold onto Geno and the music. They have never used him in ANY of their games, so what's the point of still keeping him? It must be to just piss Nintendo off as well as US. Geno is practically pointless to Square Enix. So what if they created him? Big damn deal, those guys aren't using him anymore so hand him over to a company that WILL make him useful, like Nintendo. You can keep your damn Cloud Strife, what we want is GENO!

... too bad I can't sound sarcastic through the internet. Why should Nintendo forbid them to make a game(with many fanboys) for THEIR PLATFORM because square doesn't allow them to use a character for THEIR PLATFORM? I would miss the sense in this counteraction.

Square Enix only keeps the copyrights to Geno and this music just to piss Nintendo off. They have never used Geno nor this music in any of their games, so that's my proof. Why don't people just stop buying Square Enix's games and force them to sell those copyrights back to Nintendo? That makes more sense to me, so I've stopped buying their stuff. Join me, people.
