I have to disagree with the 4409 here...its city property, and putting a sign on it is the same as defacing public property. Now, if you got permission from the OWNER of that property, then its fine. Otherwise, the 1st amendment doesn't apply when you are defacing public property or commiting a crime to do so. Second, defacing is in the eye of the beholder and some would say the sign enhanced the appearance of the fence.
Third, shooting someone is a common law "crime" an actual crime, where someone actually sustained damages. There is no victim holding a sign against a fence....I've never seen a fence walk into court and make a claim for damages :)

@soulevs There are advertisements all over public space. I did not ask them to be there but I am subjected to them daily. A graffiti artist is arrested for art on public space but big corporations are not. I can't bring a plastic chair to sit on in downtown NY but companies can put signs all over the place that I have to walk around. I hope you get my point.

Major distraction, makes my kid cry every time we drive past one. No permit; they just flaunt their first amendment rights. You don't see paid billboards on the overpass for a reason, the road signs are specifically designed for maximum visibility...so the driver isn't looking away from the road for too long. Someone dangling something there is in fact very dangerous.

I have to disagree with the 4409 here...its city property, and putting a sign on it is the same as defacing public property. Now, if you got permission from the OWNER of that property, then its fine. Otherwise, the 1st amendment doesn't apply when you are defacing public property or commiting a crime to do so. Its like punching a man in the face or shooting someone for no reason and saying that the 1st amendment said you could....makes no sense...

Second, defacing is in the eye of the beholder and some would say the sign enhanced the appearance of the fence.
Third, shooting someone is a common law "crime" an actual crime, where someone actually sustained damages. There is no victim holding a sign against a fence....I've never seen a fence walk into court and make a claim for damages :)

A graffiti artist is arrested for art on public space but big corporations are not. @galathonredd well, there is reasonable exception. but for the most part, signs do get taken down frequently. of course, it depends where you put the sign and how distracting it is, but try posting even a blank posterboard on a freeway overpass and see how long it takes for it to get taken down
And most campaign signs have permits to be put there. And I dont think any sane person would complain about missing child posters, so long as they dont pose a distraction to drivers

Try going out and holding even a plain white sign, you will probably be asked to leave. It is not an issue of your right to speak out, but rather of driver safety. He could have legally gone out and acquired a permit to post his sign, but he did not.
Just as you are allowed to peacefully protest, but you must have a permit to do so. So no, holding a sign is not protected by the 1st amendment

@soulevs Not true. Here in Bremerton, we as a community have an organization that stands around busy intersections holding huge anti-abortion signs showing disgusting mangled fetuses. Major distraction, makes my kid cry every time we drive past one. No permit; they just flaunt their first amendment rights. We call the police about these signs all the time; they tell us they can't do anything because of the first amendment.
At least we have good cops. I wish we didn't sometimes.

Maybe you are trying to make the videos dramatic, I think it taks away from the video. I would watch more, but the music is very annoying. You don't see paid billboards on the overpass for a reason, the road signs are specifically designed for maximum visibility...so the driver isn't looking away from the road for too long. Someone dangling something there is in fact very dangerous.
In my city we also have a problem with people dropping objects off the overpass. Very dangerous. Many people have been hurt and killed in the past.
Maturity is relevant because it involves knowing things like that, and respecting logic.

I will also say this, Cops sit on overpasses doing radar and sometimes lights flashing. This too is very dangerous.

Don't assume I randomly defend cops, I usually don't, but these guys were wrong, simply put. You can't stand over an overpass and dangle a sign. If wind catches it, falls on a window, causes a wreck. Let's grow up a little, this is something I'd expect from a 16 year old.

If they had "found a reason", they would have ended up in jail labeled as random rebels without a cause, and no one would have listened. This is the best they could do at getting us the truth.
