The Geneva Conventions doesn't protect illegal combatants any more than it protects nations that didn't sign on to it. If you are of a military from a country that signed and you are fighting just that, then they apply. However, even then, not all rules are abided by. It's all victor's justice.

CIVILIAN prisoners, whether foreign or domestic, are entitled to civilian trials. This is nothing new. POWs are to be tried by military tribunals, but then they have to fulfill the requirements of military combatants. Bush kept them deliberately in limbo, between definitions, so that he could keep them without trial.
As for the right to keep them until the conflict ends, sure. But that requires that the prisoners in question were caught IN that conflict, and not because they were turned in or thought to have some periferal connection to the enemy.

The reason why I am against it is that it is an unreliable method of extracting information. Even though the individual speaks, how do you really know its actually the truth? The one problem I have with your statement is that you seem to think that only United State citizens should be the only people who have rights. As far as the constitution states, all men are credited equal. I think that shouldn't be just a concept for a country, but for the world.
Actually there is an alternative to torture, which is simply interrogation without torture. American soldiers used this method in World War II, extracting useful information from German and Japanese POWs without torture, even though the Japanese were torturing American troops with such methods as waterboarding. Besides, torture generally reveals less accurate information.

I love this. America cannot compromise it's ideals in response to terrorists. We should set the standard for human rights, not lower it with torture and denial of habeas corpus. Leavenworth, Kansas. Won't it be great to have terrorists on US Soil, where it will be far easier for a terrorist organization to hold a shopping mall hostage for their release. You see... from GTMO, there's really no where to go... minefield or ocean.
They would have to be completely segregated from regular population. They would most likely be held in a government facility specially designated to house only those from Gitmo or other suspected anti-American extremists. They would actually be safer within our borders than they are at Gitmo. It would probably lessen the likelyhood of escape, too.

The U.S. should have been able to figure out in the last five or so years which of the detainees are real threats and which one's that are no threat. Those who are no real threat should be released to their homeland under the eye of their home government. Those who have been deemed a threat to the U.S. should be held and tried within our borders and within our constitutional justice system. It's not like Obama is just going to let every asshole go free just like that.

No, because Iraq has a government that wants us there for the moment. Terrorists in Iraq that we fight are classified as "anti-Iraqi forces" or AIF. The media reports them incorrectly as "anti-coalition forces." So this does not allow them to be classified as such. That doesn't really matter because detained Iraqis are given to Iraqi authorities who try them, oftentimes calling coalition troops who capture them as witnesses.

The Geneva Conventions doesn't protect illegal combatants any more than it protects nations that didn't sign on to it. If you are of a military from a country that signed and you are fighting just that, then they apply. However, even then, not all rules are abided by. It's all victor's justice.

2. there are three categories of detainies, (a) those who can be tried in us courts, (b) those who will be imprisoned by their own country and (c) those who will face a military tribunal.

In that case, the election process was definitely tampered with; and the smart thing to have done would have been to hold a new election in Florida so that any doubt about who won could have been set aside. CIVILIAN prisoners, whether foreign or domestic, are entitled to civilian trials. This is nothing new. POWs are to be tried by military tribunals, but then they have to fulfill the requirements of military combatants. Bush kept them deliberately in limbo, between definitions, so that he could keep them without trial.

What matters is that after these people were captured our leaders did not adhere to our laws or the international laws we are a party to. How can authorities expect common people to adhere to and be subject to the law if they, themselves, aren't upholding such laws?
Think about criminal law. When the cops screw up investigations, arrests & procedures the charges get dropped.

I'm actually split on this particular issue. Part of me is for it, and on the other hand part of me is against it. The reason why I am against it is that it is an unreliable method of extracting information. Even though the individual speaks, how do you really know its actually the truth? What if a person actually is innocent, but there is circumstancial evidence that seems to say otherwise. So you would torture just to make sure. And if your wrong, you just beat an innocent person.

Precisely. The most compromising and accurate information extracted from POWs usually occurs under very friendly and hospitable conditions. Germans in WWII obtained their best intelligence by outstanding treatment of POWs.
Furthermore, let's not forget those people detained in Guantanamo who are not only non-combatants, but natural-born US citizens deserving of routine civil or criminal proceedings in the US. Case in point: Jose Padilla, and there may be others.

Under international law they aren't entitled to anything but a bullet in the head. If you are fighting on a battlefield without a uniform, you are an illegal combatant and can be summarily executed. I just said that I wouldn't enjoy torture, but I would still try it.
We don't have time to torture everyone, only the big shots. You don't earn a trip to GITMO if you're just a shooter. Although you might have to deal with those redneck reservists at Abu Ghraib, which I think is unfortunate.

If they're fighting, yes, one can riddle 'em with lead in order to defend themselves or as mission dictates.
However, the moment they lay down arms, or are captured, the Geneva Conventions disagree with you. Detainees are treated as POWs until evaluated by tribunal, and should they be classified "unlawful combatants," can then be dealt with at the discretion of their captors.
And yes, we are subject to them, as they were ratified by Congress.

Geneva Conventions are old hat anyways. No one has ever abided by them, and you're only subject to them once you lose a war. Even a revision to reflect ideological hostilities would change nothing--the subjective nature of such a distinction could easily apply to nations at war. As such, the interpretation of the "armed forces" term in article 3, since it applies to irregulars, is inclusive of terrorists.
And yes, if they're not resisting, it IS required to detain them. Also, a spy is less likely to be executed at all, given the possible intel.

Terrorism nowadays is completely different. While Al-Qaeda in Iraq and the Taliban behave in the style of partisans, the scale of global terrorism is completely off the charts of anything seen even in the first half of the 20th century. GITMO is for global players, not irregulars.
Yes, you usually want to keep them alive, but not always. Established precedent would suggest that it's not required to detain them.

I am not familiar with US citizens detained in GITMO, which does not seem right. I'm not familiar with Jose Padilla, but it would seem like the government could be overstepping their boundaries. I will look into that.

Actually there is an alternative to torture, which is simply interrogation without torture. American soldiers used this method in World War II, extracting useful information from German and Japanese POWs without torture, even though the Japanese were torturing American troops with such methods as waterboarding. Besides, torture generally reveals less accurate information.

Simple battery may be the "pussiest" form of physical assault, and chlorine gas may be the "pussiest" form of chemical weaponry, but both harm people and (thankfully) legal opinion is not determined from such logic or the masochistic inclinations of a few.
Waterboarding is torture. Even if for some reason you'd enjoy the sensation of drowning (I'd bet you wouldn't), that is utterly irrelevant to what should be done policy wise.

I do agree with you that these labels are all bull, but I do believe they are necessary to distinguish between those that are uninformed from those that know what they are talking about. The terrorists will be held in New York (in the case of the man who planned 9/11 and will now not be tried for it, but rather the lesser offense of the first WTC bombing while Clinton was president), and then others will go to places like Ft. Leavenworth, Kansas. Won't it be great to have terrorists on US Soil, where it will be far easier for a terrorist organization to hold a shopping mall hostage for their release. You see... from GTMO, there's really no where to go... minefield or ocean.

They would most likely be held in a government facility specially designated to house only those from Gitmo or other suspected anti-American extremists. They would actually be safer within our borders than they are at Gitmo. It would probably lessen the likelyhood of escape, too.

Those who are no real threat should be released to their homeland under the eye of their home government. Given that there were several men imprisoned and beaten who were later found innocent, I can't imagine how anyone would be surprised to find one or more of these men might hold a certain GRUDGE against the country that kidnapped them off the streets and tortured them without just cause. "terrorists" in guantanamo? The fact is that these are people accused of being terrorists without the benefit of proof. Some are undoubtedly guilty, but the burden of proof is on the accuser. Let's say some foreign power locked you up without a trial. Whether you were guilty of their accusations or not it's their job to prove your guilt, not yours to prove your innocence.

It was in an old TPMTV, where Biden and a Republican Senator just got back from a trip to the middle east.
They said they now now have a chance to pull out of Iraq. (I tried to find the clip, but failed, I'm unsure of the exact words the Senator used.) then they announced 35,000 more troops to Afghanistan (But I have not seen anyone in the news talking about that either.) and that they wanted to give aid to Pakistan.

Torture is nothing more than an excuse to exercise sadism, as long as you understand that a lot of these people DON'T KNOW the answers to the questions these people ask, but will say anything if the torture is bad enough.
And if it's not that bad-then why would someone want to divulge anything? If Im the type of guy who blows myself up and shoots at tanks with AK's, I think you'd have to beat my ass really bad but probably just kidnap family members. Jihad is Jihad you know.
