  • That's the first time I've seen her burst out into spontaneous laughter from a case. She's laughed before but it's usually forced. You can tell this is something new to her and she's nicer and more fun. I'm sure she does get bored with the other cases. This was fun.

  • Ok so you're saying due to this clause the judge will automaticaly dissmiss any defendant breaking a lease because they think it's haunted. But I find it hard to believe that EVERYBODY is aware of this clause though. I understand it would be rare but I find it hard to believe that if a tennent sighn a lease then believes the place is haunted to the point where he or live there that NOBODY will ever claim that it is haunted in front of a judge. Maybe they just make up some other defence?

  • I worked for this tour during this lawsuit. These two friends just had a disagreement and brought it to a judge so that their friendship wouldn't dissolve.  Chuck - the defendant - is a sweet heart is not worthy of the unkind remarks being made about his appearance. I was really disappointed with his house was dropped from the tour, it was one of my favorites!

  • I ment to add in my other comment if somebody did claim they can't live in an apartment because they claimed it was haunted how would the U.S. court system handel that? Do judges believe in ghosts? Even if some do it would be awful hard to PROVE it was haunted.

  • @bandet888 Nope. There's a clause in judicial law regarding "spectral evidence" - testimony or evidence originating from sources not scientifically recognized, such as ghosts, psychics, or gods. Basically, since one cannot prove these things actually exist within the courtroom, this "spectral evidence" cannot be considered when making judgment, and is often stricken by objection.

    Who I really wanted to slap was the production team of The Show! Even though Chuck and I both "benefitted" from appearing on TV, the EDITING of the actual taping depicts a different 'reality'. Thanks for watching though. David

  • The suit was right about subsequent oral agreements. The parol evidence rule (the "four corners" rule she's explaining rather inelegantly) is only a bar to prior or contemporaneous oral agreements -- not subsequent ones. Subsequent oral agreements can modify the terms of a contract.

  • @opcond123 You are correct, but usually as in this case a subsequent oral agreement will boil down to one persons word against the others in a lawsuit. If you have a written contract it's a simple thing to modify it and if you don't (especially in Judy's court) you are going to lose.

  • In England it is possible to amend a written contract with things said afterwards. The rule JJ is talking about is called the parol evidence rule, and is becoming less strict as time goes by. The Law Commission in the UK has called for complete abolishment of it since the 1980's. Just thought you might like to know :)

    We don't know all the details, but it seems she applied PER incorrectly. It doesn't bar oral modifications after formation unless the agreement has a clause to that effect. It's designed to keep out terms the parties discarded at the negotiation stage, not exclude evidence of subsequent agreements. She probably just let it go because proving oral agreements after the fact is so hard, but she is wrong deeming oral mods inadmissible. They're fine in the US, but the PER still has bite.

His surprise at the term "Victorian" being adopted by Americans is quite understandable, since Americans are the only non-Commonwealth people to do so.
