I think you misunderstand what we consider the atonement to be--it wasn't the beatings and the torturing that made Jesus atone, but the weight of guilt and agony of conscience from sin, suffered in Gethsemane and on the cross. Such weight would be impossible for us to overcome, frail as we are.
That still doesn't explain how Jesus' suffering somehow helped. The mentality that suffering is somehow noble and pure has plagued Christianity's victims ever since.

The "spirit of the law" argument is sometimes used to justify sinful behaviour, just as some may stress certain standards are the sole crux of salvation (obedience to Word of Wisdom etc..). It can be a tightrope walk sometimes in my opinion, but the guidepost is the spirit. Hence another meaning of "spirit of the law".
