The reason he was cleared of any wrong doing is because of 'probable cause.' Probable cause dictates that as long as the officer believes there has been a crime he can investigate. - Going behind the counter. - Upon further investigation he decides to let a judge/jury decide if she is guilty and arrests her for suspicion of theft. Deciding to perform an arrest the officer is allowed to use sufficient force to arrest the suspect. In this case, pepper spray.
