The background to this ad is that a Mercedez Benz driver went off the edge of Chapman's Peak drive late one night. The car tumbled down the cliff side for about 300 feet, but the driver survived without any major injuries (to view, search for Mercedes Chapmans Peak).
BMW then did this ad. It is shot on Chapman's Peak Drive as well, but never mentions Mercedes or the car that went over the edge.
BMW won a later court case after MB brought an injunction against BMW.
