Is not a matter of burglary, in the USA every iPhone sold should be activated with AT&T. Once you take it to your country and activate it with your carrier (with jailbreak), AT&T has "lost" the phone and the income (trough monthly extra fees) that it generates in the USA

It's funny how the Apple Store surely knows that but sells the phone without problems to tourists, because they only have to sell the phone, and are not responsible for the use of it. Apple should have told them to sell phones only upon presentation of an US ID.
