When a guard sees you dont have your weapon drawn or they'll take it as a threat and attack you. Keep it sheathed and if they accept the surrender they'll still attempt to arrest you. Do it when you don't have stolen goods on you.

I made a new save and first executed all 3 persons, then i was like, what if i kill here so i did.then i had to tell a guard i killed here, so i did. and he told me to talk to someone and she told me to wipe out all DB members located in a cave then i went there killed all and then i was like nahh lets load back.
