  • Funny how he cites Bush vs. Gore when that only happened because an very Liberal, Activist Florida Supreme Court overstepped its own State Constitutional limits. The fact is, no court has any say in any election once the voting begins. No Governor or President does either. Only the Legislature of that State does. The rules must be set and in place before the voting begins and cannot be changed until after the election is decided.

  • It is the Left itself which has been most keen to assert the doctrine of judicial supremacy, because that is the only way that the Left has been able to get its social agenda enacted over the will of the people, especially in the area of sexual morality and Christianity. The 5-4 Supreme Court decision of 2000 was one of the very few Court decisions (Bowers v. Hardwick in 1986 being another) in which the Court took a position unfavorable to the Left.

  • I wonder is Thom Hartman aware that Alyona's most recent "Tool Time:Newt Gingrich" video refutes what he just said here, although she's wrong on the second point which is under Article 3 section 2 of the US Constitution. What is mind boggling is that Thom Hartman and Alyona work for the same network and yet they disagree with one another.

  • Of course, it's like that. Not because of US constitution, because of the principles of democracy.

    Unfortunately, USA is an oligarchic democracy with a judicial dictatorship. In USA, there is a Supreme Council of the Guardians of the Revolution (called the Supreme Court) that decides what is law and what isn't (like in the case of abortion). Just like in Iran.

  • @FormerlyKnownAsNopez You realize, by definition, an oligarchic democracy is literally impossible. It can't exist. There can be an oligarchy or there can be a democracy, but there can't (except maybe in the fantasies of right-wingers) be a oligarchic democracy. There could, of course, be an oligarchy that uses democratic rhetoric. Similarly, there are fascist countries like Nazi Germany or 'communist' China that have used socialist rhetoric.

    So USA is not a democracy, it's an oligarchy. Are you OK with that? Everybody can vote in USA, but the power of voting is limited by money and other oligarchic structures (e.g. corporate media that are owned by the oligarchy limit the power of the people; money is necessary to run for office).

    Actually oligarchic democracy is a democracy limited to/by oligarchy (elites, aristocracy). You had this kind of democracy in ancient Rome, later in Poland and now in Britain and USA.

  • @FormerlyKnownAsNopez The oligarchy can have vote on issues or otherwise influence by lobbying & bribes those who vote on issues. But that technically isn't democracy. Every form of govt, except an absolute dictatorship, has an oligarchy that votes on and influences how decisions are made. Back in the day, slave owners voted which doesn't mean slavery is a democracy.

    But I get your point. The danger of a representative democratic republic is it can become an unrepresentative banana republic.
