While Rare did make this game, Nintendo owns the rights to the use of the characters in it. The reason that Banjo-Kazooie and its sequel appeared on the XBLA is because they are original creations of Rare - they were only allowed to use Donkey Kong with Nintendo's permission. I hope you still have your N64!

agreed. Nintendo + Rare just works. In my opinion Rare hasn't put out as many great titles completely as they used to. They used to be the bomb now they do diddly squat in terms of the great games they have made in the past. They practically mutilated the Banjo Kazooie series, and the Perfect Dark series already on the Xbox 360. That's just my opinion since Rare's projects work way better on the king of the industry's platforms.. Nintendo :).
