  • When/where ever I see articles with titles like "is the bill of rights/constitution/# amendment, etc, dead?". This is not something that should be asked & or debated online, in the media, etc. If it's really come to the point where we are pondering & asking ourselves these types of questions, they should instead be discussed outside the capitol building, by millions of heavily armed civilians. There is no such thing as a "guaranteed" right. Rights are a precious commodity & need defending.

    it was because of the 911 call, his yelling at the police outside the apartment, and his wife saying 'let them in', PLUS his assaulting an officer that allowed the police to go into the apartment.

    that's not 'whittling away' anyone's rights. he should have:

    not thrown the phone;

    thrown other things;

    made his wife call 911;

    yelled at the police;

    blocked them when the wife said let them in;

    assaulted the officer.

    during the 'dunn' case, also 1987, the court ruled what is/is not covered by the 4th. bush was president.

    or go to the 'hester' case (also before the supreme court). it was 1924, which said 'open fields aren't covered by the 4th' and said only 'curtilage' is. that was 37 years BEFORE OBAMA WAS BORN.

It wasnt right then and its not alright now but then people actually paid attention to what bush and the government was doing, unlike today where they are shredding the 4th and no one is saying a word.

    the police were responding to a 911 call placed by mr. barnes' wife. he was throwing the main phone against the wall to keep her from calling her sister. she used her cell phone to call 911 and said he was throwing things around. it was a 'domestic dispute'.

    he walked out, ran into a police officer, they told him they were responding to the 911 all, he said he was leaving, the wife threw a bag at him.

The need for warrants led to the compiling of evidence against the people, With these laws flushing a toilet or running the sink can be construed to be "destroying of evidence" It is not the point of these two cases per say but the change in those rights opens up the door for abuses in future incounters. When future admins determine me or you are bad, the rules will be in place to arrest you with no evidence to the contrary.

  • @TheStrazy thing is, look at the 4th. it doesnt say warrants are needed for ALL searches. it protects 'persons, houses, papers and effects' from 'unreasonable searches'.

    in the case of the yelling husband, one could argue that the 911 call (domestic dispute) made by his wife, plus his wife saying 'let them in', plus his yelling at the police (who told him to stop yelling or he could be arrested for disturbance of the peace) all allowed the police to enter his home 'reasonably'.

  • @neoconsnightmare3 The solutions are simple vote in members who will vote in laws prohibiting lobbyist and giant conglomerates, That cater to the infrastructure of the military complex, from buying votes, which lead to wholesale overstepping of the constitution to keep up the prison population for personal gain. I'd make the case that the very notion of acknowledgment that people WILL have cause (but no recourse) regarding future (formerly illegal) actions denotes the predisposition for this bill to be interpreted as pre-existing criminal intent, with pre-existing criminal amnesty built right in. You can argue that it's legal, but it's clearly unconstitutional.

  • @RetSquid This is not to be dismissive or evasive, since I haven't read it in a week, but look back over it, and see if that 'final say' may also be retroactive. I admit I could be wrong on that. But if not...

    I think the most disturbing part of all is the sidestepping, incrementally with this and other bills, of key provisions of the constitution. In this case...'probable cause', with the new standard being 'reasonable suspicion'. Also bypassing specific target identification.

    I will have to find and read the entire Act to get all of the facts about this, but the amendment here gives some pretty good assurancesagainst it's misuse. It is for emergency orders from only a few people and it has at least two levels of review, from the courts and from congress.

    The bill protects the telcoms from suit but not the AG (I don't think). And it is still overseen by the courts, also with periodic review by Congress.

  • @RetSquid Well, that reassures me completely. I mean, Congressional review is certainly going to help people a lot. I do enjoy your use of the word 'overseen' by the courts. A little more than cursory examination shows that essentially, the courts are a rubber-stamp. At this point, it would take a monumental effort to get a case to the Supreme Court in order to rule on the basic unconstitutionality of this bill, since that would be a natural consequence of being able to sue the telcom at all.

They infiltrate different groups, like the Tea Party or good patriotic militias. They then try to radicalize the people, people who may have not been violent or extreme in any way.
