Sotomayors has more experience than anyone on the bench. In a 5 to 4 decision I think it is hard to say that it was a unanimous Supreme Court decision.

The Supreme Court today reminded all courts and governments that equal justice under the law means refusing to tip the scale in favor of one race over another,The Senate Judiciary Committee should carefully examine Judge Sotomayors role in the Second Circuits opinion on this case. Discrimination and racial preferences have no place in our courts, let alone on the highest court in the land.

She was basically saying, as someone who faced both sex descrimination and race discrimination, she is able to empathize with others who faced similar situations easier than a white male who has not faced such situations. She went on to say, however, that it is not impossible for the white male to empathize with those discriminated against. Brown V. Board of Education is the obvious example. She was stating a fact of life.

Every Federal Judge (that includes Supreme Court Justices) is an activist judge, unless they NEVER over turn a lower court decision. Scalia, captain of the "Original Intent" movement is an activist judge. He would like to over turn many of the so-called liberal policies, programs & laws that have been established over the years, but he has been unable to get the votes. Of the 9 Supreme Court Justices, only 3 have had more than 10 votes against them and all of them are Republican nominees (Roberts - 22, Alito - 42, and Thomas -48), not to mention Bork, who was voted down.  Now which party unfairly scrutinizes the nominees. It seems to me that the Democrats were first in overstepping the advise and consent role and now the Republicans are striking back. Its not right, but it is understandable.

The quote from Sotomayor was 100% correct in context as she stated her upbringing in the "latino community" would make her much more valuable in contextual situations than a white male who has not lived that life. Anything wrong with that? No, it is factual.

Or makes her more qualified to apply the laws in the book better than anyone else? She has consistently showed blatant racial favoritism in her decision as a judge, more recently in the New Haven Fire Department where white firefighters were denied promotions because they were white. She thought that was OK. Funny how you left that out in your anti-republican rant.
