Listening, for unusual activity is a very important fundamental aspect of police patrol work. SPD leadership has not removed entertainment radios from the patrol cars and instituted a policy prohibiting officers from using them when they're on patrol. Strike one.

Birk got out and yelled "hey, hey, hey" to get the attention of Williams. Professional police officers are trained to make contact by saying "excuse me Sir." The video tape that the department released containing excerpts of other contacts with Williams. It is obvious that when officers used respectful language with Williams they received full cooperation. When they used abrasive language he yelled back at them. SPD has done nothing to change the way these officers communicate. Strike two.

If he would have yelled out "Stop, Seattle Police Officer" I'd say that was acceptable given that he thought Williams was a threat. But he (Cowboy Birk) also said that he was making contact to "check the welfare" of Williams in a "caretaker" capacity. He flip flopped on that - probably a result of being all amped up on sports talk radio...

While Birk just stands there with his gun drawn on WIlliams as he bleeds, his FTO leads officers in the approach Williams as if he's some strange and dangerous beast that can not die - like you see in a horror movie. He may have been killed because he failed to obey a direct order from a police officer. It's not that Williams was completely deaf: he was deaf only in one ear, and actually owned a radio, but he had headphones and he may have been wearing them when he was shot and killed.
