  • The I.R.S. demands that you provide them w/the evidence w/which to secure your conviction in tax "court." (Tax courts are territorial & thus can't be operated w/i the states.) Accordingly, using I.R.S. "logic," a car thief is guilty of stealing the car & guilty of not reporting the theft. This legal fiction denies a citizen his right against self-incrimination. The burden of proof lies with the plaintiff (the I.R.S.) to prove the defendant guilty. It used to be: INNOCENT till proven guilty.

  • I wonder who the guy beside Irwin is. He clearly loathes him -- conspicuously refusing to acknowledge his presence in the slightest way.

  • @7beers The guy beside Mr. Schiff is also a tax protestor. He is featured extensively in the same documentary that Irwin was in, "America: Freedom to Fascism".

  • He's not in jail for publishing the book, he's in jail for not paying taxes on proceeds derived from the sale of the book. There is a difference between the two.

  • The U.S Supreme Court has ruled that the taxing limitation in Art.1, sec.2, clause 3; and Art. 1, Sec. 9 Clause 4 of the constitution prohibiting the Fed. Gov. from imposing ANY tax directly ON the people, are still in effect. And that the 16th Amend. did NOT nullify those limitations nor authorize any direct tax ON the people.

  • And where is Irwin Schiff today? Serving a 12 year prison sentence in a federal prison in Arizona at the age of 82. Way to go, Irwin! The guy is an idiot. His whole premise that there is no Constitutional right for the government to tax incomes is bogus. United States Constitution, Article 1, Section 8 grants Congress the power to impose taxes. It does not restrict this imposition and does not prohibit Congress from taxing personal incomes.

The Internal Revenue Code is now known as the “Internal Revenue Code of 1986” as a result of changes made by Public Law 99-514, 100 Stat. 2085 (10/22/1986).

  • One thing that nobody seems to think about is the very real fact that government does serve a purpose in our lives and that it cannot exist without revenue. Yes, our gov't is wasteful and often inefficient, but if it suddenly disappeared our society would degenerate into chaos very quickly. All gov'ts claim a right of taxation and cannot survive without it, with the exception of certain oil-rich countries in the Middle East that don't need to collect taxes---at least not yet.

  • I love Irwin Schiff. He's a true freedom fighter.  We need a million more just like him. The working people of this nation prop-up a bunch of parasites and bums in Washington D.C., living the life of hi-rollers at the working man's expense.

  • The IRS establishes power over you by the use of common law notices and applying liens onto your corporate Trust.

    Check out the names Bill Thornton (1215 org) and Adam Adask who explains how they lawfully get power over you.

    Still, they can be stopped though by using your own lawful notice, not using your corporate Trust (not being held as the Trustee with fiduciary duty) and by counterclaiming to challenge jurisdiction.

  • On January 21st, 2004 Schiff filed a brief in the District Court of Nevada Civil Case CV-S-01-0895-PMP (LRL) claiming "Insanity" in his defense for failing to pay his Federal Income Taxes! He contends he suffers from a mental disease or defect and exhibits symptoms of chronic severe delusional personality disorder!

  • NO, he was BS-ing to get out of paying his taxes and got caught.

  • That is exactly what I said. He believed it to be unconstitutionally and ethically enforced and as a last ditch effort decided to fake insanity to reduce his sentence. So what? He believes the law is wrong, and is unconstitutional, he gets caught and doesn't want to be thrown in prison despite how the law reads it. Big deal.

  • Well if this type of taxation is illegitimate and in his idea illegal, then trying to get out of imprisonment for some bogus law by lying may be legitimate. It's kind of like saying is it wrong to lie to a thief about where you have hidden your gold when he breaks in your house. Is it so bad to lie to the thief? Of course you either have to assume that all taxation is theft or illegitimate forms of taxation are theft. But think about it that way for a moment.

    Tax protestor and promoter Daniel Benham of Twin Lakes, Michigan, was convicted of tax evasion for failing to file tax returns from 2000 to 2003.
