False DMCA-ers will never go to court for three reasons: 1) They'll be looking right away at perjury charges. 2) They'll be subject to treble damages on a countersuit of spurious litigation. 3) They will never get a lawyer to take their case.

@Gingerkiller99 I think being "permanently banned" means that specific account is permanently banned, rather than the person or their ip. I'm sure YouTube can ban people's ip addresses, but in the case of DMCA bans and other bans from rule-breaking, it's just that specific account that is banned.
