From what I can gather. In most states, if you get your own dump of a game that you own you can run the backup of the actual game. There are a few ways to get the ROM files off of the cartridges and if you got your own it's legal.

It doesn't really matter though, if you're gonna get busted for illegal downloading stuff this falls under a much more obscure category than music or movies.

Guys, Guys. You don't need 120 stars, and Yoshi only appears when you HAVE 120 stars. You can get up there by wall kicking, if you try hard enough. The same trick can be done of Super Mario 64 DS.

You don't have to fly into the wall to go inside of the castle like that.  But how did you get up there with that many stars?

you go to the edge near the hill on the right side of the castle do a double jump onto the hill then a third on the hill hold left and you can grab the edge of the castle.
