I never saw or heard about Russo being a consitutional activist way back at this time in the late 80's. Of course I was pretty self absorbed living life too. Most people were. Its been a steady wake up call for me since Columbine.
What needs to happen is, when we see a cop with someone pulled over, 25 or 30 of us need to pull in beside them and block them in. Front, rear and sides, and verify what this cop is doing and why. You know, I'm against mob rule, but to say were purely a republic is discounting an obvious fact. In this republic, we are born with god given rights, but who decides these god given rights? To say god is a little ridiculous, as it's just a metaphor for rights that your born with. The reality is each of those rights had to be agreed upon in a democratic way. Please explain. I really don't see any holes in my logic. While it is true we are born with rights the majority can't take away, those very rights AT SOME POINT had to be agreed upon. They didn't just come out of nowhere. Therefore a majority vote had to be made, ex. for the Bill of Rights. One person didn't decide them, they were agreed upon. What does that sound like to you? I get the point of what your trying to say. I am no dog. I am 24 now and have been awake since I was in the 3rd grade.
If you were a tyrant there would be a vote. There isn't always a line drawn like that, but sometimes there is. If it was agreed your a tyrant, it is well within my rights to kill you if you don't step down.
Why is there is 5h amendment? Because there was some consensus reached from past governments that it is a right to not be forced to incriminate yourself. It had to be decided to be put into the context of freedom, if that makes sense. Like it had to be rationalized somehow, and agreed upon.
In fact, amendments must be voted on, correct? It is a rule that at some point was agreed upon by a governing body, be it common sense or not. Maybe I'm not right, maybe I'm not wrong. This is honestly something I haven't come to a firm conclusion to, and that's the one of the reasons I am debating it.
You bring up some great points itsahatch and they shouldn't be dismissed so quickly. I think our founders made a democratic decision to avoid a democracy and instill a republic. It seems contradictory but I don't think it really is. In America we hold certain truths to be self-evident, (like 4409s comment on killing being bad) Sadly it seems that this sentiment is fading, and a pure democracy is replacing the original "self-evident" truths of the republic.

What needs to happen is, when we see a cop with someone pulled over, 25 or 30 of us need to pull in beside them and block them in. Front, rear and sides, and verify what this cop is doing and why. If they arrest those 30 people then next time make a hundred...and next time make 200. That's what they did in a little bugtussel town in Ohio. For about 3 or 4 years you almost couldn't get pulled over in that town. The cops were too scared. Several got their asses beat and others resigned.....LOL

You know, I'm against mob rule, but to say were purely a republic is discounting an obvious fact. In this republic, we are born with god given rights, but who decides these god given rights? To say god is a little ridiculous, as it's just a metaphor for rights that your born with. The reality is each of those rights had to be agreed upon in a democratic way. Please explain. I really don't see any holes in my logic. While it is true we are born with rights the majority can't take away, those very rights AT SOME POINT had to be agreed upon. They didn't just come out of nowhere. Therefore a majority vote had to be made, ex. for the Bill of Rights. One person didn't decide them, they were agreed upon. What does that sound like to you? I get the point of what your trying to say. I am no dog. I am 24 now and have been awake since I was in the 3rd grade.

If you were a tyrant there would be a vote. There isn't always a line drawn like that, but sometimes there is. If it was agreed your a tyrant, it is well within my rights to kill you if you don't step down.
Why is there is 5h amendment? Because there was some consensus reached from past governments that it is a right to not be forced to incriminate yourself. It had to be decided to be put into the context of freedom, if that makes sense. Like it had to be rationalized somehow, and agreed upon.

In fact, amendments must be voted on, correct? It is a rule that at some point was agreed upon by a governing body, be it common sense or not. Maybe I'm not right, maybe I'm not wrong. This is honestly something I haven't come to a firm conclusion to, and that's the one of the reasons I am debating it.

You bring up some great points itsahatch and they shouldn't be dismissed so quickly. I think our founders made a democratic decision to avoid a democracy and instill a republic. It seems contradictory but I don't think it really is. In America we hold certain truths to be self-evident, (like 4409s comment on killing being bad) Sadly it seems that this sentiment is fading, and a pure democracy is replacing the original "self-evident" truths of the republic.

It provides inalienable rights. It was created for to avoid a government that had divine right over the individual, because if they will do it for a good reason, they'll do it for a bad one. It echo's Kohlbergs stages of moral development.

There were posts made saying that this wasn't a democratic republic, it's a constitutional republic. While I don't disagree, my point was that there had to be some form of democracy in the creation of the constitution and bill of rights and documents of the like. @itsahatch The states unites under a Constitutional Republic. They did NOT vote democratically the laws in the US constitution. Think about it, The founders did not sit about to form a constitution where the laws in it were determined by mob rule. Check out the federalists and anti-federalists papers where ultimately a constitution was ratified. It was the best the signers could ALL agree on. The 10th was put there to limit scope of federal power.

Democracy is just a method selected to select representatives. That method could be changed when we find a better one.

It seems you have quoted Sanford Levinson's in the link...he is known for his knowledge of American constitution, nevertheless, it is his interpretation.
The Constitution clearly declares USA to be a republic as in Article4 Sec#4:
"The United States shall guarantee to every State in this Union a Republican Form of Government,.."

Nope ... it is a REPUBLIC as it says very clearly in Artcle 4 Sec 4 .. and NOT a democratic republic.
You have to show something in the Constitution (the final word) that mentions that the USA is anything apart from a REPUBLIC.
It does not need any qualifier or adjective ... you start adding those and before we know we will be arguing if sky is purple (for aperson wearing apurple sunglass) or snow is blue (with blue sunglass).
